For the second time three Port
land policemen have refused to
testify before the Police Internul
Investigation Audi, Committee
(PIIAC). Since October the com
mittee has I Mien trying to make
the officers testify laifore it con
cerning two alledged cases of
police misconduct. The police
union and Chief Penny Darrington
and Commissioner Dick Hogel
i 1mm that PIIAC has no authority
to order the three policemen to
testify, even though the committee
was given subpiMina powers in
1983 when voters approved Ballot
Measure 51.
This ballot measure was passed
after two scandals occurred in
1980 and 1981 involving Portland
police officers. Former Mayor
Frank Ivancie and former Police
Chief Ron Still, Commissioner
Mildred Schwab, and the police
union were against Ballot Mea
sure 51. The police union spent
$70.000 in an effort to defeat the
ballot measure. Since then the
police union and the audit com
mittee have been involved in con
flicts over the < ommittee’s autho
rity.
A City Council committee which
oversees the citizens panel voted
to reissue the subpoenas; now the
full City Council must
matter. Up until las,
Darrington had been
cerning the officers'
vote on the

Last week the chief said the PI I AC
was overstepping its authority by
issuing the subpoenas. Darring
ton's statement is an example of
the confusion surrounding the
interpretation of Ballot Measure
61
The ordinance creating the
measure sets out the following
three functions for the PIIAC: 1.
monitoring the pro< ess to insure
tha, citizen complaints are inves
tigated in a manner that is fair,
efficient, thorough, and timely; 2.
reporting the resultant findings,
conclusions, and recommenda
tions in written form to the Police
Commissioner and the public a,
large; 3. providing an avenue of
appeal for citizens dissatisfied
with the police handling of their
complaints. The ordinance also
sets forth in specific terms the
means by which these functions
are to he accomplished The com
mittee is given the power to
compel the attendance and testi
mony of persons, administer
oaths, and to order documents
and other evidence to be pro
duced.
