On or about February 4 1965 the City ot Portland will request the U S
D ep artm e n t o f H ousing and U rban D ev e lo p m en t to release Federal
funds under Title 1 of the Housing and Community Development Act of
1974 IPL 93 3831 to be used for the following project
Im provem ents to streets in Lents Area 100 yr floodplain Streets to
be improved in area bounded by S E. Steele. S.E 102nd. Johnson
Creek and I 205. also S E Knapp 183rd to 9 2n dl and S E Rural
187th to 92ndl
It has been determ ined that this request for release of funds w ill not
constitute an action significantly affecting th e quality o f the hum an
environm ent and. accordingly, the City o f Portland has decided not
to prepare an Environ m ental Im pact S ta te m a n t under the N atio n a l
Environmental Policy Act of 1969 IPL 91 1901
The reasons tor proceeding with this protect are as follows

There are no practical alternatives to the floodplain location Numer
ous streets within the area are unimproved or below city standards,
do not qualify for m aintenance, and are som etim es im passable
due to flooding The neighborhood is in need of new streets and
drainage to increase neighborhood livability and pedestrian /traffic
safety

The City of Portland. Bureau of Transportation Engineering, wiH under
take this protect with federal funds from the U S Department of Hous
mg and Urban Development under Title 1 of the Housing and Com mun
Ity Development Act of 1974 The City of Portland is certifying to H U D
th a t th a C ity of P ortland J E Bud C lark, in his o fficial c ap a city as
M ayo r, consent to accept the jurisdiction o f th e Federal courts if an
action IS brought to e n fo c e responsibilities in relation to environmental
reviews decisionmaking and actum and that these responsibilities have
been satisfied
The legal effect of the certification is that upon its approval the City ot
Portland may use funds, and H U D will have satisfied ns responsibilities
under the National Environmental Policy Act of 1'ffiR
H UD will accept an objection to its approval of the Release of Funds and
acceptance ot the certification only if it is on one of the following bases
al That the certification was not in fact e ie c u te d by the chief execu
live officer or other officer approved by H U D or
bl That the applicant's environm ental review record tor the protect
indicates omission of a required decision, finding or step applies
tile to the project in th e e n v ir o n m e n ta l r e v ie w tu n c ess

The protect is in com pliance with state and local comprehensive
plans
An Environmental Review Record of this protect has been made by the
City of Portland, Bureau of Community Development which documents
the environm ental review of th e protect and m ore fully sets forth the
reasons why an Im pact Statem ent is not required This Environmental
Review Record is on file at the above address and is available for public
examination and copying, upon request between the hours of 8 (JU a m
and 4 30 p m , Monday through Friday
Objections must be prepared and submitted m accordance with the re
quired procedure. 124 CFR Part 581 and may be addressed to H U D at

Objections to the release ot funds on liases other than those stated above
will not be considered by H U D No objection received after fifteen days
from the date of receipt of the request for release of funds by H U D will
