Gregory Kafoury (right) dlacuases consumer law w ith Ralph Nadar.
A lawyer for unpopular causes
Graxsroot News, N W — The ster
eotype image o f a radical lawyer is
one o f long hair, beard and raving
rhetoric at the courts. Gregory Ka-
foury defines himself with this term,
yet bears none o f these conventional
notions. At 36, Kafoury is clean
shaven, well-dressed and with
Douglas Hagen runs a relatively suc
cessful law practice. " In 1971, when
I applied to law school, the number
o f people who applied increased by
a factor o f three. The major reason
for this increase was Ralph Nader,
because he showed at a time o f
grinding repression that one person
could stand up and cause things to
Change. He did this as an attorney,
which provided inspiration to an en
tire generation.” Kafoury believes
dial he tries to do what he can with
this principle in mind. " I'v e made a
com m itm ent.”
This commitment was made by
Oiany attorneys but was kept by
only a few. " A lot of people who
went into law school with high
hopes found out that those hopes
dipped away when they left law
school. They reasoned a short stay
With a large law firm for the experi
ence and later open a revolutionary
tew commune. The reality is they
went to work for a law firm , got
married and had a child. A ll o f a
sudden they were hooked where
they were, 30-ycar-old experts on
municipal bonds needing at least 30
thousand a year jus, to pay the
house notes. So, under these
circumstances you are no, a very
good candidate for doing all the
things you once thought von would
Unpopular cases like police bru
tality arc no strangers to Gregory
Kafoury. " I n 1974, my parther and
I hung up a shingle after we gradu
ated from law school and the main
source o f our income was criminal
court appointments. I was really
shocked by the number o f people
who came in and off-handedly ex
plained how the police battered their
heads against the sidewalk, e tc ....
No one seemed to be very interested
in this complaint. A ll o f a sudden
the dam broke, thanks to Der
Connel, and people began to realize
that the situation went a long way
beyond that. I think there has never
been a commitment to do anything
about police brutality. I find the
same names coming up over and
over. We have won cases which cost
the City o f Portland a fair amount
o f money. And in each case we
found out that there was absolutely
no discipline taken against the o f
fleer. There is no discipline taker
against officers i f the ju ry finds per
ju ry or brutality. It does not matter
what happens in court. It seems that
the whole system is rigged."
In light o f Kafoury's experience
with this subject, can we as Oregon
ians seek redress through the sys
tem? " I think that people need to
press all over. I f it happens to you,
take it to the D .A . and make them
take a stand.”
Kafoury has been on the right
hand for many defendants and ex
plains the reasons fo r the dispropor
tionate number o f minorities incar
cerated. "T he bum rap that m inori
ties get from the crim inal justice
system is just the tag-end o f the bum
rap they get from society. The juries
have no idea how it is to grow up in
a racist society. But viewing the
crim inal justice system as the prob
lem is not helpful. I t ’ s an extension
o f (he problem, and the problem is
society itself.”
Oregon’s governor is reinstating
the death penalty. Does Kafoury be
lieve in it? "O n ly fo r N ixon! 1 al
ways tell my pro-death penalty
friends i f they Ic, me k ill Nixon for
using the highest office in the land
to destroy democracy then I w ill le,
them have some o f those poor jerks
who got so twisted that they finally
exploded. U ntil we have a system
that would really draw the moral
conclusions that need to be drawn,
it's debasing fo r us to k ill. Now,
there are a few really dangerou?
people ou, there who need to be pul
on ice, permanently. Bu, for the so
ciety to k ill is like beating someone
up in handcuffs.”
