Question: What does the Oregon Em
ployment Division law say about “suit
able work" in relation to claiming Unem
ployment Insurance benefits?
Answer: Employment Division law
makes reference to the suitability of work
in several areas involved with claiming
unemployment insurance benefits. An
individual must seek suitable work, can
be disqualified for refusing an offer of
suitable work, or for failing to apply for
available suitable work when so directed.
The law then establishes certain suit
able work factors: In determining wheth
er or not any work is suitable for an
individual, the administrator of the Em
ployment Division shall consider, among
other factors, the degree of risk involved
to the claimant's health, safety and
morals, the claimant’s physical fitness
and prior training, his experience and
prior earnings, his length of unemploy
ment and prospects for securing local
work in his customary occupation and the
distance of the available work from his
residence. The Employment Division law
also establishes certain conditions under
which work would not be considered
suitable: “(al I f the position offered is
vacant due directly to a strike, lockout or
other labor dispute. <b) I f the renumera
tion, hours or other conditions of the
work offered are substantially less favor
able to the ind>vidual than those prevail-
ing for similar work in the locality, (c, I f
as a condition of being employed the
individual would be required to join a
company union or to resign from or
refrain irom joining any bona fide labor
organization."
