considering a project for which financial assistance is being
sought from the Urban Mass Transportation A d m in istra
lion, pursuant to the Urban Mass Transportation A ct of

Section 5 of the Urban Mass Transportation A ct of 1964.
as amended, provides federal operating assistance to U rban
Mass Transportation systems, w hereby the T r i County

eligible to receive federal funds for operating assistance for
fiscal year 1975 1976 This project is included in T r i M e t’s
program of projects for fiscal year 1975-1976 and is a p art
of the C R A G transportation developm ent program.
T h e estim ated cost of the project is (5.533,682. Federal
participation w ill be (2.766.841 and the local share w ill be
(2,766,841 allocated from the funds collected by em ployer
payroll taxes.

the social, economic and environm ental aspects of the
project.

considering an am endm ent to a previously approved capital
grant.
In Ju ly . 1971, T r i M e t submitted to U rban Mass
Transportation A d m inistration (U M T A ) a capital grant
application for the purchase of new buses and operating
equipm ent, new maintenance equipm ent, renovation of 75
old buses. 100 bus passenger shelters, new bus stop and
inform ation signs, and the purchase of 1.033 acres of land.
In June, 1972, U M T A approved the original grant
application.
In M ay. 1973, U M T A approved a budget
am endm ent making the total grant (7.646.500.
T r i M e t desires to amend the approved grant w ith in the
approved grant budget to purchase more land than the
1.033 acres of originally requested.
T h e additional land is located at the northeast corner of
the intersection of Southeast 16th Avenue and C enter
S tre e t identified in public records as lots one through eight
inclusive. Block T hirteen, Benedictine Heights, a subdivi­
sion of Portland. Oregon.
This property is c urren tly owned by Portland General
E lectric Company and has been cleared of all im prove­
ments, thus no persons, families or businesses w ill be
displaced by this project. T ri M e t desires to purchase and
im prove the property for the purpose of providing off-street
T ri-M e t employee parking.
This w ill vastly im prove the
neighborhood environm ent by shifting existing o n s tre e t
employee parking to an off-street site.
A t the hearing T ri-M e t w ill afford an opportunity for
interested persons or agencies to be heard w ith respect to
the social, economic and environm ental aspects

Bui suppose you do start using
it. O r give it away to a friend. Or
loss il into the ashcan. Then, ac­
cording io an old common law
doctrine, you have "exercised
dominion" over the hook and
must pay for it.
Under this doctrine countless
consumers, over the years, has;
paid for things they did not really
want.
But now most states as well as
Congress have passed special stat­
utes changing the common law.
These statutes usually allow the
recipient of unordered merchan­
dise to simply treat il as a gift
This does not mean, however,
that the recipient can take unfair
advantage of hia new privilege.
Say a delivery boy leaves a carton
of groceries on your doorstep by
mistake. And you know perfectly
well that the groceries were meant
for the people next door
You might argue that this was
“unordered merchandise." hence
yours to keep for nothing. But
chances are that the statute would
not he held applicable in the event
of an honest mistake^.
In one case a man received the
annual renewal of an insurance
policy from his broker For two
months he kept it. making no re­
sponse. Then he informed the
broker that he was not taking the
insurance.
But in these circumstances, a
court ruled '-te r. the man could
he held liable for at least the two
months' insurance. The years of
previous dealings, said the court,
had justified the broker in assum­
ing that "the retention of the
policy implied acceptance "

Public Notice is hereby given th a t the Portland
D evelop m ent Commission w ill receive cost proposals for
Consultant services until O ctober 27, 1975, for design, and
developm ent of w orking draw ings and specifications for
im provem ents in Dawson P a rk located in the Eliot
Neighborhood in N o rtheast Portland.
Such services shall include:
1. Design of a new pavilion structure to replace the
existin g s tructure in Dawson Park.
2. Design of autom atic lawn and landscape sprinkler
system for park grounds.
3. P reparation of w orking draw ings and specification for
item s 1. and 2.
4. M eetings w ith neighborhood groups and C ity agencies
as necessary.
In te re s te d parties must m eet pre-qualifications criteria
established by the Commission. P re qualification question
naire forms and detailed inform ational packets regarding
the Dawson P ark Project are available at the office of the
