ment of Housing and UrbanDe-
velopment, the NAACP hous­
ing expert said that " a depart­
ment which promulgates reg­
ulations, monitors itself and,
upon receipt of complaints in­
volving its own operations, in­
vestigates itse lf, cannot be ex­
pected to render self-incr im­
inating decisions."
M r. M o rris urged "th e re­
vision of existing legislation
to enable the government to
acquire land and develop suit­
able housing in communities
where racial o r economic dis­
crim ination denies equal ac­
cess to housing."
WASHINGTON — Clarence

Washington Bureau of the Na­
tional Association fo r the Ad­
vancement of Colored People,
was scheduled to testify this
week before the Senate Ju­
d icia ry Committee in opposi­
tion to confirmation of W illiam
H. Rehnquist fo r the Supreme
C ourt of the United States on
the basis of the nominee's
a n ti-c iv ii rights record.
Shortly
after President
Nixon announced his nomina­
tion oi M r. Rehnquist, leaders
oi the Phoenix, A r iz , NAACP
Branch-S tate Senator Cloves
Campbell, B illie M ills and
Robert Horn—cited his oppo­
sition to c iv il rights legisla­
tion and school desegrega­
tion plans in his home city.
They called fo r rejection of the
nomination.
A t a meeting of Washington
representatives of the Lead­
ership Conference on C ivil
Rights, Nov. 2, it was agreed
that the Conference would of>-
pose the Rehnquist nomina­
tion and would testify against
it. M r. W ilkins ischairm an of
the Conference and M r.M itc h ­
e ll, chairman of the group's
legislative committee.
A Leadership Conference
report said: " M r . Rehnquist
was the only m ajor public w it­
ness (in 1964) against a Phoe­
nix public accommodations
law, arguing that the right of
private property took prece­
dence over public convenience
and principle. When there was
a move against 'de facto' seg­
regation
in
the Phoenix
schools in 1967, Rehnquist op­
posed the move, stating, "W e
are no more dedicated to an in­
tegrated society than we are to
a segregated society.' "
Representatives at the Nov­
ember 2 meeting "w ere also
persuaded to oppose the nom­
ination by evidence of M r.
Rehnquist’ s extreme rig h t-
wing views, expressed in pro­
nouncements he has issued as
head of the Justice Depart­
ment’ s o ffice of Legal Coun­
sel, in which he attempts to
ju s tify wiretapping, imprison­
ment ofdemonstratorswithout
due process and denial of full
constitutional rights to Fede­
ra l, state and local govern­
ment employees and to wo­
m en."
Neither the NAACP nor the
Leadership Conference took a
position on the nomination of
Lewis F .P o w e ll, J r , of V ir ­
ginia whom President Nixon
named fo r the other Supreme
Court vacancy at the time he
announced the Rehnquist nom­
ination. In a letter sent to
branch leaders throughout the
country, M r. M itchell noted:
"W e are concentrating on the
Rehnquist nomination because
die record on him is clear. We
do not have the same kind of
information on M r. Powell.
However, this does not mean
that we support the Powell
nomination."

Executive D irector Roy W il­
kins addressing a mass meet­
ing at the annual conference
of the V irginia State NAACP in
Did Point, warned that the Ar­
izona nominee, now a top law­
yer in the Department of Jus­
tice, "o ffe rs a J mgerous fu­
ture” as aS uprenieiLurt Jus­
tice because "he may not be
able to see you for law and or­
d e r."
