pieces of legislation
are being heard almost every
day as each chamber labors to
get through the vast number of
b ills which must be voted upon
before the session ends.
In the House this week one of
these important b ills was pass­
ed on the flo o r from the House
Environment Committee.
HB
1065, known as the nuclear siting
b ill, would establish a H -
member Nuclear and Thermal
Energy Council with authority to
determine the siting and moni­
toring of future power plants
with 250,000 or more kilowatts
of
e le c tric ity . The Council
would consist of the directors of
specified state agencies includ­
ing the Department of Environ -
mental Quality, State Water Re­
sources Board, Fish
Com­
m ission, Game Commission,
State Engineer, State F orestry
Department, State Geologist,
Department of A griculture, and
Economic Development D iv i­
sion, as well as two représenta -
tives from statewide environ­
mental organizations, a radio­
logist, a person appointed by the
County government in which a
site is being reviewed, and a
public
member designated
chairman of the Nuclear
and
Thermal Energy Council.
The Council would be re q u ir­
ed to conduct studies to
de­
termine areas suitable
for
thermal power plants, and to
conduct a 24-hour monitoring of
the environmental and eco -
logical effects of the construc­
tion and operation of thermal
power plants. The b ill would
give the Council authority to
order the operation of a plant
halted without a hearing or any
p rio r
notice if the Council
judges the activities of the plant
to be detrim ental to punlic
health and safety. Once a appli­
cation fo r a plant site is receiv­
ed, the b ill would also require
that a hearing must be held with­
in 60 days and a decision made
within 90 days following
the
hearing.
In the area of consumer pro­
tection the House has taken
a
m ajor step in establishing
a
comprehensive consumer pro­
tection package, which is sup­
ported by most of the House
members and is designed
to
provide protection against de­
fective products and
un­
scrupulous and deceptive trade
practices.
The m ajor proposals in this
legislation are designed to: (1)
redefine deceptive trade practi­
ces and plug loopholes which are
not covered by present law; ( 2 )
provide
the State
Attorney
General with authority to es­
tablish by ruling that certain
conluct is misleading
and
therefore prohibited; (3) p e r­
m it individual citizens to bring
suit fo r damages
against a
company arising out of a w illfu l
deceptive trade practice, which
present law does not allow; (4)
prohibit re fe rra l sales; (5)pro-
vide restrictio ns against home
solicitation sales of consumer
goods and services; (6) require
that telephone solicitors identi­
fy themselves and reveal
the
purpose of th e ir call within the
fir s t 30 seconds.
