HOME DECLARED HAPPY Alleged Statement That She Thought Greta Moore Was Treat ed "Shabbily" Is Denied. An Intimate friend of Mrs. Jessie Elrod Moore for more than 12 years, Mrs. Minnie Hadley of The Dalles testified as a star witness yesterday In the case of the proponent of the will contest now on before Judge Tazwell of the circuit court, In which Mrs. Greta Moore Thompson seeks to et aside the will of the late L. K. Moore, leaving his estate to her' step mother. In Moro, Or., where witnesses for the contestant had related numerous instances of cruelty to the girl Greta. Mrs. Hadley visited the Moore home three and four times a week. "In all of that time I never knew of anything unpleasant In the home," said Mrs Hadley. "It was a very happy home. Greta always seemed happy, was well-dressed and very pretty. In Portland, where I visited with the family on numerous occa sions, Greta looked as well dressed or better than the average girl." MlMtrrntnirnt 1" Denied. In all her close association with Mrs. Moore Mrs. Hadley never saw Greta mistreated In any manner, she said. "I never saw her shabbily dressed," said the witness. "Jessie and Greta seemed very fond of each other. It was a happier home than the major ity of which I knew." The basement room occupied by the girl at Moro and described by wit nesses for the other side as dark and cold was "a cool, pleasant room." according to Mrs. Hadley, who said she "never thought of it as a base ment room." These were answers elicited on direct examination by Attorneys E. V. Littlefield and Bert Haney. On cross examination by Dan J. Malarkey, who. with E. B. Seabrook and Arthur A. Goldsmith represents the young woman, Mrs. Hadley conceded that if she- "knew" that Mrs. Jessie Moore had treated her stepchild in the man ner described by witnesses for the contestant that she would have changed her opinion concerning the happiness of the home. But she did not believe the many cruelties which had been testified to had ever occurred. "I don't believe any of the terrible things witnesses for the other side I: ave said," declared Mrs. Hadley. "Shabby" Statement Denied. "Simply because of your Intense partisanship and friendship for Mrs. Moore, you believe that anything any one would say against her is false?" asked Malarkey. "I can't believe It. because I knew her for so long and never saw any thing of the kind," was the reply. Mrs. Hadley denied that she had ever told Beulah Hayes or Mabel Moore that Bhe thought Greta Moore Thompson was treated "shabbily." Attorneys for the contestant drew a comparison between the financial status of the Hartleys and the Moores. eliciting the admission from Mrs. Hadley that the Moores had a more palatial home and an automobile, a luxury not afforded by the Hadleys, yet the Hadleys sent their daughter through four years of college, gave her a handsome trousseau when she was married and a church wedding. G. A. Taylor, executor of the Moore wilt was a witness much of the day. He was confused concerning the num ber of visits Mrs. Moore had made to his cfflce following the death of her husband, to see the will, and in the afternoon denied making any of the statements read to him from a steno graphic transcript of his te(timony In the morning, saying that he be lieved the court reporter was quoting from the wrong witness, as he did not recall testifying as reported. The case was adjourned until Mon day. DEATH HI IS DISOWNED MRS. JOHN BURNS XOT SUKE ABOCT REVOLVER. Wife of Alleged Slayer of Special Agent Phillips Takes Stand for Defense. Mrs. John Xj. Burns, wife of the man on trial for murdering James H. rhilllps, testified on the witness stand yesterday thnt the revolver which she had identified In a former 'trial as her husband's was not his. but possibly belonged to Pan Casey, his friend, who is sentenced to hang for complicity In the same murder. The positive testimony of Robert Traddock, police revolver expert and last witness for the state, had been that the revolver traced to Burns was the one which fired the bullet which ended Phillips' life. Testimony concerning weather con ditions on the night in question oc cupied much of the defense efforts yesterday, aimed to disprove the pos sibility of the positive identification given by a state witness of Burns as the partner of Casey in the railroad jards shortly before the revolver duel in which the special agent lost his life. j 3 HURT IN AUTO CRASH ' Men Injured, but Women Escape ' When Street Car Hits Machine. Three men were hurt, one of them seriously, and two young women es caped Injury, early yesterday morn ing when the automobile in which thiy were riding east in Irving street collided with a streetcar going north in Twenty-third street. Deonard Barber, 4S7 Salmon street, was still in Good Samaritan hospital last night with severe lacerations on the head and possible internal injuries. Cecil Harnark. 344 ' Columbia street, and Norman Brink. 744 Kearney street, driver of the automobile, were able to leave the hospital yesterday morning after their cuts and bruises had been treated. ' Liquor rot-HWHor Pleads Guilty. VANCOUVER. Wash.. Jan. 7. (Special.) Jamea A. CUngenpeel. who operated a pool hall and soft drink place on Third street, between Main and Washington, and which was raided by Sheriff Thompson and deputies in December, today pleaded guilty to having Intoxicating liquor in his possession. He was fined $254 and costs by Frank E. Vaughan, jus tice of the peace. Cltngenpeel ran upstairs on the night of the raid and broke a number of containers of moonshine with an axe, to keep the sheriff from obtaining evidence, the sheriff reported.
