Jensen, proprietor of the Viaduct garage, was found not guilty of substitution of motor oil In a trial by Jury in the court of District Judge Belch yesterday afternoon. 114 nn unusual verdict returned, the jurors attached tho comment that it was their opinion that "if any misdemeanor was committed, btiit was instituted against the wrong in dividual." The actual effect of tho verdict was to Infer that tho law had been violated in the garagre attacked, but by a subordinate without the knowl edge or active consent of tho pro prietor, Jensen. The technical vic tory was the first case to be lost by the stato in six prosecutions brought . acainst local garagemen, The de fense was handled by Attorney Ar thur C. lmyton. Johnston, who shot his wife three times Thursday morning and then shot himself in the head, had not regained consciousness last night. Physicians at St. Vincent's hospital said his condition was unchanged, al though there is a good chance for life. Relatives who reached the city yes terday said Johnston was very excit able and extremely susceptible to grievance from trivial adversities. FINE FOR ASSAULT Man Who Beat Up His Father-$n-Law Must Pay Levy. Solomon Miller, lawyer, druggist and dentist, who seeks $151,001) in damage suits recently filed in the - circuit court against his wife's rela tives, was fned J9 99 for an assault on Morris Sigel, his father-in-law, by District Judge Deich yesterday. The attack took place January 1 at the home of a sister-in-law. Coincident with the assault trial was the arrest of Miller on a secret Indictment charging him with threat ening to commit a felony and his re lease on bail of $1000. Mrs. Violet Miller, his divorced wife, was the chief witness against Miller before the grand Jury, asserting that on December 19, 1921, Miller told her he would kill her. At the time of the assault on Sigel, Miller accused his father-in-law of endeavoring to take away Miller's child, whom he was visiting. Sigel, who Is 63 years old, was knocked down by the younger man. It was testified. Judge Deich Imposed the $9.99 fine on the theory that Miller would "re member It longer than a $10 fine." CONCORD BUILDING SOLD Trice Not Made rublic, hut Valua tion Suid to Be $125,000. The six-story Concord bnilding, located at the southwest corner Qf Hecond and Stark streets, has been sold by tho Lurid Estate company to R. D. Sigler and associates, ac cording to announcement made yes terday by Fred Strong, manager, of the company. The sale was consunl mated December 9, but the announce ment was made only "yesterday. The price was not made public, although the building was said to be valued at approximately $125,000. I Mr. SIgler said" that the purchase had been made as an Investment for himself and associates. The building occupies a ground epace of 60x95 feet. The' United States National bank formerly occupied the corner space. Since the bank vacated the Equitable Savings & Loan company has been located there. CHURCH PROTEST HEARD Congrcgatlonulists' Tlea Is Re- . ferred to Council's Committee. With what were said to be good prospects of an amicable adjustment, tho protest of the Alameda Congre gational church against the entrance of the Methodists nearby, filed with the Portland council of churches by the pastor, Iter. Robert Allingham. has been referred to the council's committee on survey and comity, ot which Howard D. Hasklns is chair man. This committee, it so happens, la scheduled to meet next week, ac cording to lie v. Ralph C. McAfee-, executive secretary of the.couneil. The- protest was filed -by Kev. Mr. .Allingham when he learned of the ' purchase by the Methodist Episcopal church of ground for a church at East Twenty-sixth and Fremont streets, after preparations had been made by the Congregationallsts.
