Wholesale looting of the assets of
the Colby Steel & Engineering com
pany by Its president and principal
stockholder, Mark K. Colby, was
charged In a sensational suit filed in
the circuit court yesterday by K. N.
Allen on his own behalf and for other
lntereste4 stockholders In the con
cern. Judgment for 33.7115 at 8 per
cent since January 1, 191S, was de
manded from Colby, this being the
total of sums he was accused: of ap
propratlng to his own use from
funds du the corporation. Cancella
tion of a JIO.OOO note Colby holds
against his company and of a stock
Issue of $13,900 to Colby also were
asked. An accounting for ail funds
was demanded and an Injunction
eought to prevent Colby from remov
ing any of the assets from the Juris
diction of local courts.
Contracts Held Canceled.
On four different occasion Colby
was said to have canceled firm con
tracts for the sale of locomotive
cranes, making secret sales in some
rases for more than double the orig
inal contract amounts and pocketing
the difference. Records of the firm
have been hidden or scattered so that
they are not available to stockhold
ers and Colby repeatedly has threat
ened to leave for South Africa with
the entire monetary assets of the cor
poration, saldi Allen.
The firm is capitalized for $50,000,
tut only 355 shares of stock have
Tioen lBsued, of which Colby owns
262 and the plaintiff, Allen, STA.
Colby controls the concern absolutely,
being president, manager and direc
tor. It was assorted.
The sales which were said to have
enabled .Colby to swell his personal
bank account were all made in 1917.
The first Instance alleged was the
cancellation of a contract for the sale
of a crane to the Donaher Lumber
company for $8281 and the secret re
sale to the Seattle Construction &
Irydock ' company for $19,860. Colby
Is charged with converting the $11,669
profit in the second transaction to his
own use instead of turning it in to
the corporation.
Crane Sale.Held Canceled.
The next instance cited was the al
leged cancellation of a sales contract
for a crane to the Vancouver harbor
commission for $10,702 and secret sale
to the Seattle Construction Dry Dock
company for $16,600, making a $5893
profit never acounted for on books of
the steel company. Another referred
to was the cancellation of a contract
calling for the sale of a crane to tbe
Todd Dry Dock & Construction com
pany of Sea-ttle for $8141 and the sub
Huquent private eale to the Skinner
A Eddy corporation of Seattle for
$14,850, with $6709 profit.
The final case cted was the al
leged sale of a crane to the Seattle
Construction & Dry Dock company
for $16,S50 after a contract with the
Todd Dry Dock & Construction com
pany for purchase of the machinery
for $8350 had been canceled. This
profit of $3000 reverted to the private
use of Colby, it Is claimed.
Out of the private profits Colby
was said to have made by these ruses
he loaned the company of which he Is
president $10,000. Cancellation of
this note Is one of the demands of
the suit, the claim being made that
the money already rightfully be
longed to the corporation.

charged that Colby assigned to him
self $13,900 worth of stock In the cor
poration. Real ownership of the pat
ent always belonged to the company.
It was asserted.
The most recent Improper acts al
leged In the Buit were the payment
of commissions of $280 to one Gilbert
Duffy and $150 to one George Olson
Inst July out of company funds for
work alleged to have been performed

Old Man Incompetent.
Was Jamei T. Anderson insane on
the morning: of May 24, 1921, when he
beat his aped wife to death with a
hand ax and in explanation of hla
deed told the authorities after giving
almuelf up that he did it to put her
cut of misery? ' .

Wilson. The slaying Is admitted by
the defense, which contends that An
derson was not In his right mind at
the time. Emotional insanity, com
bined with the lapse of memory ruse
made use of in recent sensational
murder cases, Is not pleaded in this
trial. Instead, Attorneys Collier and
Berr.ard contend that senility had
weakened the mental faculties of An
derson. '
State Presents Four Witnesses.
The first day of the trial, the prose
cution, handled by George Mowry,
deputy district attorney, contented
itself with producing four witnesses.
One was the deputy coroner who took
chatge of the body of the murdered
woman. Sheriff Hurlburt and two
newspaper men who interviewed the
slayer at the county Jail a few hours
o-fter the murder were the other wit
nesses. The latter testified that Anderson
had discussed the killing freely at
the jail, justifying his act by saying
that his wife had been declared a
hopeless Invalid by physicians and
that he was doing her a kindness In
ending her life. Anderson further
had said that his home life always
had been happy.

failed when one of the newspaper
men who talked with Anderson that
morning declared that the picture
was not a true likeness In that a
wild expression, of the eyes had not
been noted in the murderer on the
occasion and probably was due to the
glare of the flashlilght by which the
photograph was take a.
Hugh C. Krum, son-in-law of An
derson, was the first witness for the
defense. He testified that he had
known the family for 16 years and
had been married to a daughter of
Anderson for 12 years. On the morn
ing of the murder Anderson tele
phoned Krum asking for a son. Will,
and eaylng that Mrs. Anderson was
dead.
Tells Children of Killing.
The testimony of Mrs. Susie Krum
and William Anderson was that when
they both arrived at their father's
home he was sitting in a chair, de
jected; that they asked if their mother
had "died easy" and that he replied
she had not, that she had "died hard,"
following this remark with: "There
is no use denying it I killed her."
He asked If they had had any break
fast, it was testified, and put a coffee
pot to boil on the stove.
.P. N. Forsythe, close friend of the
family; Mrs. Cecilia Kelly, a daugh
ter, and Mrs. Mary Schaeier, another
daughter, all testified for the defense
that Anderson had appeared worried,
fretful and irritable prior to the
tragedy for some time.
Anderson Declared Insane.
It was their opinion, and also that
of the Krums, that Anderson had been
Insane at the time he killed his wife.
Expert testimony of alienists has not
yet been presented.
Mrs. Krum testified that her fath
er's worry was accentuated by the
fact that he had worked only about
one month out of six prior to the
killing and had been living on his
savings, of which only 200 was lett.
Anderson probably will take the
witness stand this morning.
13-YEAR-OLD BOY GONE
Ellsworth Hicks Missing From
Home Since Monday.
HOOD RIVER. Or., Nov. 8. (Spe
cial.) Authorities are perplexed over
the inability to find Ellsworth, 13-year-old
son of Mr. and Mrss. J. S.
Hicks, who disappeared from home
at daybreak yesterday. Posses
searched from noon yesterday and
all night, and men and women have
scoured the vicinity today. Neighbor
ing towns have been asked to watch
for the boy, who wore a pair of
overalls over his pajamas when he'
left here. He was bare-headed. His
hair is brown, eyes hlue.
A brakeman of the Mount Hood
Railroad company reported seeing'
two boys, one without a hat, cross
ing the Hood river bridge at 6:30
A. M. yesterday. '
Dairyman Gored by Bull.
ASTORIA. Or., Xov. 8. (Special.)
Pe'ei- Hedlund, a Grays River. Wash.,
dairyman, was in St. Mary's hospital
tontpht recovering from injuries re
ceived at his home when a Jersey
bull which he was attempting to feed
became enraged and gored him,
breaking several of Hedlund's ribs
and lacerating the flesh of one leg.
