Decision Known Today.
TRIAL TAKES TWO WEEKS
Portland Company Prosecuted for
Alleged Illegal Combine to
Restrain Trade.
After a deliberation of nearly ten
houra, the Jury sitting in the case of
the government against R. P. But-
cbart, president, and Clark Moore,
sales manager of the Oregon Portland
Cement company, handed in a sealed
verdict to the court.
The verdict will be opened this
morning before Federal Judge Bean.
The Jury retired at 12:45 P. M. yester
day and the talesmen could not agree
on a decision: until about 10:30 o'clock
at night.
By stipulation of counsel for both
sides, the jury was allowed to submit
a sealed verdict, s that the jurors
could return to their homes for the
night. Two weeks' presentation of
evidence preceded the placing of the
case In the hands of the Jury. A for
mer Jury disagreed) on the same case.
Traat Law Violated, Charge.
The company is being prosecuted
under the Sherman anti-trust law
on the charge of entering into an
illegal combine for the restraint of
trade. The maximum sentence for
conviction under this section of the
Sherman law is a fine of $5000 and
imprisonment for one year.
Final arguments by United States
Attorney Humphreys were presented
yesterday morning. Federal Judge
Bean completed his instructions to
the Jury shortly before 1 o'clock. In
his Instructions Judge Bean called
attention to the fact that while
Butchart had denied telling Amar
Moore, star government witness, that
he had formed the alleged illegal
combine, as attested by Moore, he did
not deny that such a combine had
been established. Butchart, declared
Judge Bean, failed in his testimony
to explain certain letters introduced
in evidence by the government tend
ing to show that such a combine was
formed. Because of these two facte,
the jurist said, the jury might draw
a legitimate Inference that an illegal
combine was formed.
Operations Held Extensive.
The government maintained In the
ease that an agreement was entered
Into by the local company with con
cerns In California and Washington
for the purpose of restraining trade.
The defense denied all charges as to
arbitrary division of territory ' and
ether accusations made by the govern
ment and advanced the prevalent car
shortage as the sole reason why only
orders within certain territories could
he taken and filled. Assistant United
States Attorney Luek was associated
with Mr. Humphreys In the prosecu
tion, wnile the defense was conducted
by Wirt Minor and Andrew Winfree. I

CHARITY FUND IS ASKED
More Ample Provision In County
Budget Is Demanded.
An urgent demand that the 1821
eounty budget make more ample pro
vision for charity and philanthropic
eases .during the coming year was
tnade upon the county commissioners
yesterday by Ben Selling and Bishop
Walter Taylor Sumner, who prophe
sied that more money will be needed
. for relief work during the next year
than since-1914.
The county has set aside 145,000
for relief work, but both Bishop Sum
ner and Mr. Selling contended that
at least $75,000 will be needed during
the coming year.
"You haven't any moral right to cut
down on charity or philanthropy,"
challenged Mr. Selling, when members
ef the board said they were without
funds to make the requested increase.
"You men ought to have enough
tamina to do a your consciences
dictate regardless of any criticism
which might be directed against you."
The board' took the request under
advisement, but tn so doing made It
plain that at the present time they
can see no hope of Increasing the
budget for this relief work.
