JUDGE DISMISSES CASES THEATRICAL FIGHT TO COME UP IX CIRCUIT COURT. J arist Thanks Attorney for Suggest ing: That He Throw Out All Charges. A record was made In tha trans action of difficult business In the municipal court yesterday morning: whan four attorneys appeared before Judge Rossman representing- the principals In the Jensen-Woodruff -Jones-Lacey entanglement Involving charges and counter charges of assault and battery growing out of the fight between the unions and the moving picture theater operators. "Give us time, judge." pleaded Attorney Ryan, representing Jones and Woodruff in the various com plaints. "I ask that the hearing be set over until Tuesday to permit tis to get at the facts in the case." "Let's finish it up now," said Dan J. Malarkey. who with John K. Losan represented Jensen and Lacey. "We nave an Injunction suit pending the circuit court and we want to get mis on our nands. "Tuesday," insisted Mr. Kyan. "Do it now," said Mr. Malarkey. All four attorneys began to talk at once. The clock -on the courtroom wall registered 11:30 it would soon be time to eat. The jndye looked gloomy. A happy inspiration seized Mr. Logan. "I'v-e got an idea, judges" he said. "Why not dismiss all the charges and let 'em fight it out in the circuit court?" The four attorneys stared at each other. A whispered consultation followed. Then the quartet faced the court again. "Fine, Judge," they chorused. "Dis miss 'em all." A happy smile replaced the gloom on the judge's face. "Mr. Logan," he said earnestly, "I thank you for the first ray of sun shine introduced into this court. All charges are dismissed." The blanket dismissal of charges by Judge Rossman included individual charges of disorderly conduct against Jensen and Jones; individual charges of assault and battery brought by Jones and Woodruff against Jensen: charges of assault and battery brought by Jensen and Lacey against jones ana woodruff, and an indivi dual charge against Woodruff Drought by Lacey. NflN-PARTISfiK MOVE SEEN 38 ORGANIZERS DECIaARED AT WORK IX OREGON. Judge Stapleton Makes Address at Realty Board Luncheon; "Knock ers' Day" Held. That the non-partisan league now has 38 organizers in this state work ing quietly in. the effort to obtain memberships and that a big meeting and demonstration is planned shortly after election day. after which the or ganization will come into the open in a battle to control the political power of the state, was the declaration of Judge Stapleton. in speaking before the realty board at the regular week ly luncheon of the Portland Realty Board yesterday noon at the Portland hotel. "In North Dakota." he said, "the non-partisan league has been a polit ical agency for the past five years and the state now is bonded to such an extent that it will take half a century to pay its debts. As a place where men and women can live In peace and harmony, with community prosperity and co-operation. North Dakota has become impossible." The speaker declared that in Wash ington the league is ready to enter me political field this fall, while in California, where co-operative mar keting is successfully carried on, the league has not got a foothold. From this example he urged the passage of the co-operative marketing meas ure at the fall election. Yesterday was "knockers' day" at the realty board luncheon, and nearly an hour was spent In constructive criticism of the board's activity, and the realty profession In general. Har ry Beckwith brought up the matter of the exclusive contract and urged that all realtors operate under that arrangement. The resignation of W. R. Kaser as second vice-president was ac cepted, and George T. Moore, a promi nent local realtor with offices in the Teon building, was elected to fill the varancy. Liquor Seized Is Stored in Warehouses. tYhlsky Is No Longer Poured Into Sewers or Streams, but la Taken Over by Uncle Sam. VANCOUVER, Wash.. Sept. 24. (Special.) What becomes of the bonded whisky, the moonshine, the white mule, the various kinds of wines and intoxicating liquors seized by the sheriff of the county in his many raids from time to time? This is a question that has been asked many times. Well, the bottles are not broken, nor is the liquor poured into the sewer any more. No longer will it pollute streams and kill the fish. It is not consumed by the sheriff and his deputies, either. No, it is all taken to a big storehouse of some kind in Tacoma, provided for this pur pose by the government. As the stock accumulates in the various offices of the sheriffs throughout the state it is taken in charge at irregular pe riods by prohibition agents, who take It to the warehouses and store it. Today William Vest, prohibition agent for this district, took a large quantity from this county, another consignment from Kalama and an other quantity from Chehalis. " What the government does with this liquor is not known here, but it Is known Uncle Sam docs not care what kind of whisky it is. he takes it all, just the same. So that is why there are no scenes of a sheriff and his deputies breaking bottles and let ting the liquor go into the sewer. Grave Dynamiters Fight $70,000 Judgment. lwi. Wash.. Man Has Remark able Legal Caae on Handa. MORTON, Wash.. Sept. 24. To get judgment in two courts In the sum of 170,000 for having a grind stone and a "sang" hoe blown from the grave of his great-grandfather, and then to have to fight the legal battle all over again and cross the continent to do it, is the experience of 1. M. Lester of Lewis, in the extreme eastern end of Lewis coijnty, who passed through Morton Wednesday en route to Mossy Rock, where a brother lives with whom he was going to con fer on the extraordinary legal case. According to Mr Lester, when he disposed of his land in West Virginia, u eicepiea a tract taken up by a cemetery. In this cemetery were buried many relatives, among them his great-grandfather, who had taken back east with him after one of his western trips a real grindstone. The people in that section then, said Mr. Lester, had been forced to cut their grindstones out of native rock and they were ungainly things and hard to work with. Mr. Lester's forebear expressed a wish that when he died his grindstone and his "sang" (ginseng) hoe be buried with him. They were. Later the new owners of the land wanted the cemetery removed, . to which the former and original owners objected, especially as they had spe cifically excepted it from the deed conveying the property. Still later, according to Mr. Lester, the new own ers began paying taxes on the land in cluded in the cemetery plot, and when they got ready to remove the bones, blew them from the ground with dy namite. AInnsr With tri. rsnn tt hig great-grandfather came the afore- I said grindstone and "sang" hoe. When descendants in the west heard of the act, which seemed a sacrilege, they brought suit for $70, 000 and got judgment for the full amount, said Mr. Lester, in two courts. Now, he says, he has been ad vised by his attorney that the whole thing must be gone through with again, and he expects to leave In time to reach his old home in West Vir ginia by October 10, when the third trial is to open PRUNE DAMAGE HEAVY Rain-9 and Wind at Dallas Cause loss In Thousands of Dollars.
