Belt of McMinn ville, sitting in Portland, directed a verdict in favor of the defense with the comment that the charges were wholly without merit. Jn bringing an article to the news paper for publication, Hanville in vited whatever adverse criticism might be forthcoming as a result of the airing of his views, held the judge, and could not hold a news paper liable for printing the other ;de of the controversy he had started. Merit fa Cane Seen. "Still, if I thought there was any merit in the ease I would resolve the doubt in favor of the plaintiff and submit the issues to the Jury," aid Judge Belt. "Any man who projects' his private affairs before the public and gets the worst of it is not entitled to sympathy. I believe that when the plaintiff went to The Oregonian and asked it to publish his story which, I inuet say, was a foolish and absurd flaunting of per sonal troubles he made The Ore gonian his agent and was bound by anything which would naturally re sult from the controversy which he began. 'Vurther." continued the Jurist, "being a school principal he occupied a nuasi-publlo position by reason of w hich he was obliged to submit to fair and reasonable criticism. The public generally has a right to know about the men who take and hold pulilln positions. A newspaper has ho greater right than you or I to malign, hut It has a duty to perform in in fbrrrving the public about public men and matters. ?So Malice Shown. "There has been no evidence of actual malice in the case and it was incumbent on the plaintiff to prove actual malice, for implied malice is not sufficient when the article pub lished conic under the classification or a pnviee:eu communication, as this was. The article would have been libelous per se if it were not privileged. "The original story printed by the newspaper was a fair account of the material Mr. Hanville submitted and he invited whatever adverse criticism came after the publication of that fctory. The defense in the case rested on Thursday afternoon, and the plain tiff yesterday mornjng after brief testimony, of Hanville in rebuttal. There followed argunieilt on a mo tion for a directed verdict, .1. J. Fitz gerald representing The rejronian and Nelson It. Jacobson. the plaintiff. Indignant Denialn Made. Tlfinville was discharged from the position of principal of the Adair school, Astoria, early in 1918. On March 20, 1919, ho assaulted H. L. Hussong. superintendent ot schools at Astoria, in revenge for the dis charge of the year before, fled to Portland to escape arrest, and took to The Oregonian a story he had written concerning the affair, in which he posed as a man who had been wronged "because he proposed like a true American to the girl of h,is choice. Indignant denial of assertions made in the published version of Hanville's tale came to the newspaper from Astoria the next day arid the answer to his charges was printed. The fol lowing day the newspaper afforded him space to reply to the Astoria al legations. He later filed suit for l.'iO.OOO damages alleged to have been sustained by reason of the second article published. The alleged libel told of Hanville's career In Astoria or that which led to his discharge from the school his annoying attentions to Miss I.ela Ash worth, a pretty younir woman who had received numerous unsolicited and unwelcome love letters from Han ville despite her protests. The con tents of these letters were an amus ing chapter of th libel trial. WIFE'S STATUS CLAIMED -SfRS. A. Ii. BJORKLCXD DEXIES MARRIAGE ILLEGAL. Letters of Administration of Es tate of Late. Husband Asked In Woman's .Petition. Mrs. Frarikie Bjorklund, denying that she was not the legal wife of the late August L.. BjorklunH. whd died from a bullet wound received In a supposed scuffle with his wife oh Ulay 21. 1920, filed a petition for let ters of administration to the estate of her husband in the probate division of the circuit court yesterday. A prior petition seeking the ap pointment of Ernest I. Bjorklund, brother of the deceased, on the grounds that Mrs. Bjorklund was not the true wife of August Bjorklund, cornea up for hearing before Circuit Judge Tazwell this morning. The peti tion filed yesterday sets the stage for a contest. The brother claims that Mrs. Bjorklund was married within three months of her divorce from another husband, while the statutory requirement was a six months' delay before remarriage. Mrs. Bjorklund asserts that property- left by her husband was worth in the vlcln'ty. of $10,000, of . which $754)0 was real estate In Multnomah county.a portion real estate in Clarke county. Wash., and the remainder his interest In a grocery at 676 Thurman street and bank deposits. When she married him in February, 1919. he had $4800 in the bank, she asserts, saying that she believes most of it still la there. Holstein. Breeders Assemble. CHEHAUS, "Wash., June .11. (Spe cial.)
