R Nine men, arrested driving machines S with dealers" license tags, appeared i rA In the mifnicinal' court yesterday to , Ta answer to charges of violating the motor vehicle laws and having im proper license tags, and the hearing assumed more the nature of a con ference between the judge and the dealers in the effort to get a satis factory settlement of the difficulties. The judge had previously held a con ference with Cantain Lewis of the traffic department, and his ultimate decision was one which was apparent ly entirely satisfactory to all concerned. . Salramen Mnat Drive Dealer Cars. The judge specified in his decision that the car bearing a dealers li cense tag must at all times be driven by an auto salesman or dealer and that at no time should such a license tag be attached to a service car. "If at any time an auto salesman abandons his work of selling auto mobiles to engage in other pursuits, even though he should confine those pursuits to the evening hours after j his day's work of selling automobiles might be completed, he is not entitled to use a car bearing a dealer's license while engaging in such variations from his general occupations," the luclire declared. The judge also declared that the construction of the law prohibited a dealer loaning the machine, with dealer's license, to his wife for the purpose of making a shopping tour. He said that the machine must be driven by a dealer or salesman. Gainful Puranlta Barred. A dealer might drive his family to a show or about the city in the eve nings in his car with a dealer's li cense tag. the judge declared, ac cording to his construction of the law. He said he could see nothing oppos ing the use of the car for innocent pleasure, particularly evenings, pro Tiding the dealer or salesman was driving and he was not engaging in gainful pursuit other than the sale of machines. He said he opposed too Struct interpretation of the law, other wise there would be no value to the use of a dealer's license. The judge said that his interpreta tion of the law would not prohibit the use of the dealer's license on demonstration cars, as such machines were used In the consummation of sales and were ultimately sold. Two of the men appearing in mu nicipal court yesterday were arres.ted for having dealers license tags on service cars, a use of the tag contrary to the decision of Judge Rossman. The judge, however, declined to set fines in any of the cases, preferring to give the two a chance to apply for regular license tags. Those who appeared In municipal court were George V. Adams. R. O. Burnett. E. D. Baker. R. Jackson. E. A. Burness, TV. M. Thompson, G. H. Gates. H. W. Lyon and H. A. Aucpach. Ten arrests were made yesterday by Patrolman Leavens on charges of j violating the state automobile law, the majority of these Involving charges of failing to have proper li cense tags. Those arrested are C. X. Johnson, student; Ralph Heimucker, brakeman: A. Foster, machinist; R. E. Finch, salesman: Robert F. Maguire, attorney; A. H. Fries, auto dealer; X. C. The directors con curred and the letters will go for ward today. At the same time the state chamber of commerce is send ing the letter to member bodies. The position of the chamber Is set forth as follows in recommending the points deemed of greatest importance: "L'rge a rate-making rule that will stabilize railroad credit and attract new capital. This rule should have no hard and fast limitations or guaran tees other than to provide for fair return on Invested capital after tak ing Into consideration reasonable cost of maintenance and operation. Includ ing labor, depreciation and taxes, all to be, permitted under reasonable rates to be fixed by the Interstate commerce commission. The strong western roads upon which Oregon de pends should be encouraged to use their best enterprise and efficiency. Bids by. sheepmen at Fort Simcoe for lease of Yakima reservation -ranges during the coming season showed increases of 100 to 150 per cent over the bids made a year ago. In. many cases several bids were of fered for one range. The high bids reached $2.19 per ewe and lamb for summer range and 2.15 for winter range. .....
