proposed constitutional amendment to
be submitted at the regular election
In November, the present same and
fish commission will be abolished and
In its stead there will be appointed
by the governor a fish culturist who
ehall hold office at the pleasure of
the executive and who shall have
charge of all game and fish propaga
tion and distributions.
The proposed amendment was pre
pared at the instigation of the Clack
amas County Fishermen's union, ac
cording to a letter received at the
offices of the secretary of state, and
has been referred to the attorney
general for ballot title.
License F"ee Prescribed.
"The license fees for hunting or
shooting game birds or game animals
lor a resident of the state shall be $1
for each county wherein the license
is taken," according to the amend
ment, "and ?5 for each non-resident
of the state for each license. The
license fees for taking or fishing for
game fish shall be ?1 for each county
wherein the license is taken out for
& resident of the state and $5 for each
non-resident.
"No license relating to game fish.
frame birds or game animals shall
entitle the holder to fish or hunt or
pursue or take fish or game outside
the county wherein issued. All
licenses required under the proposed
act shall be issued by the county
cleric or the county wherein the same
ehall be used.
Officer Would Be Appointed.
"All officers or deputies required to
enforce the laws for any of the pur
poses named in this section, includ
ing the regulations of hunting or
fishing or the conservation of coi
mercial or game fish or animals or
birds, except sheriffs or constables
elected by the people and the duly
appointed deputies of such sheriffs,
shall be appointed by the county
court or the commissioners' court ot
the county wherein such officer or
deputy is required to work.
"The county clerk monthly shall
send to the secretary of state 25 per
cent of all fees collected from
licenses relating to game fish, game
turds and game animals and 75 per
cent of all fees collected for licenses
relating to commercial fish. The
license fees retained by the county
clerk shall be used to defray the ex
penses of enforcing the laws and the
provisions of this section applying
the same to that branch respectively

Propagation. Fund Provided.
"Of the balance retained, if any, a
portion of all may be used by the
county for the propagation or dis
tribution therein of commercial fish,
game fish, game birds and game ani
mals and any remainder must be
turned over to the secretary of state
at least once a year.
"The propagation of commercial fish
ehall be paid for out of money de
rived from licenses relating to com
mercial fish, and game fish, game
birds and game animals shall be prop
agated and distributed from money
derived from licenses relating to
such game.
"The salary of the fish culturist
shall be not more than $3000 per
annum and neceseary expenses. The
salaries of officers appointed by
county courts shall not be more th i
$125 per month and necessary ex
penses. Counties to Regmlate Seasons.
Except as to waters in regard to
which a joint agreement exists be
tween the state , of Oregon and state
of Washington, each county may reg
ulate all seasons for fishing or the
closing of any stream or part thereof
and the use of fishing gears within
its boundaries to the exclusion of the
etate. Such action of a county shall
be by vote of the people of such coun
ty upon initiative petition at regular
or special elections called by the
county court of such county.
"The duties required of the secre
tary of etate as to state legislation
by initiative shall be performed as
to this legislation by the county
clerk; the duties required by the gov
ernor shall be performed by the coun
ty judge and the duties performed
by the attorney-general shall be per
formed by the district attorney for
each county.

Ii. Schaer Files Answer to Suit of
"Xachrichtcn," in Which
Fraud Is Alleged.
Not only does L. Schaer, proprietor
of a lot-al dry-cleaning establishment.
admit that his advertisement appeared
for 52 successive weeks in the "Nach
richten," a German newspaper which
is suing him in the circuit court to
recover a sum alleged due for adver
tising, but he asserts, in his answer
filed yesterday by John V. Cahalin,
that publication of the advertisement
never was authorized by him and had
damaged his business to the extent of
$300 because of the alleged disloyalty
and pro-Germanism of the paper in
which it appeared.
Schaer says that on November 23,
191S, he was solicited for an order for
business cards by an agent represent
iner A. E. Kern & Co., who did not
"disclose to him that the name A. E.
Kern & Co. was an assumed and ficti
tious name under which the German
Publishing company was doing busi
ness." An order was given for 500U
cards and 1000 tags, it is set forth,
and Schaer was told by the agent that
it was necessary for him to sign a
written order. He did not read the
order carefully, he declares, and later
found it to bo an advertising contract,
which he had been induced by fraud
to sign.
Schaer found out that the adver
tisement was appearing in the Ger
man paper on December 1, 1918, and
immediately ordered it discontinued
as unauthorized and was informed by
A. E. Kern that a year's contract had
been signed and that it was the inten
tion "to publish it in said German
paper for the full 52 weeks." This
was done over the protest of Schaer,
who is now being sued, he declares.
