HELENA. Ark. Nov. 3. Rapid
progress marked the trials today of
cases growing out of the recent race
disturbances south of this city, one
negro being- convicted of first degree
murder after eigrht minutes' delibera
tion by a circuit court jury, and five
ethers receiving a verdict of guilty to
a similar charge, all at the same
time, after the jurymen had been out
seven minutes. The verdict means
electrocution for the six negroes.
Jn the first of the two cases tried
today, that of Frank Hicks, several
witnesses for the state testified they
saw Hicks fire the shots the morn
ing of October 1 which resulted in
the death of Clinton Lee. an ex
6oIdier. Defense Has No 'Witnesses.
The defense announced it had no
witnesses, argument was waived, the
jury was instructed and in eight min
utes a verdict was returned.
Defendants in the second case were
Frank Moore, Ed Hicks, J. E. Knox.
Paul Hall and Ed Coleman, charged
jointly with the murder of Lee. Wit
r.eFses testified that Moore, Knox and
Hicks acted aa leaders. Arguments for
a verdict of second degree murder
were presented by counsel appointed,
instructions were griven the jury' and
a verdict of first degree murder "was
returned in seven minutes.
122 Under Indictment.
Indictments have been brought
against 122 persons, mostly negroes,
as a result of the disorders.
Evidence showed the existence of
e. post of the Progressive Farmers
ai.d Householders' Union of America,
the organization under which it is
alleged the. uiegroes were banded for
the uprising- at Elaine, resulting in
the death of five whites and a larger
number of negroes and the wounding
of others.

After a conference which lasted for
five lours the majority of the mem
bers of the special housing code com
mittee agreed upon sufficient recom
mendations to make it possible for
City Commissioner Barbur to prepare
and present to the city council a ma
jority report on revision of the code.
H. M. Easterly, member of the com
mittee and representative of the Port
land Housing association, alone stood
against some of the recommendations
and the proposed report probably will
go before the city council without his
name. The remaining four members
agreed to concessions which will be
embodied in the proposed report. City
Building Inspector Plummer was as
signed the task of preparing the pro
posed report which will be ready dur
ing the latter part of the week.
The agreement reached yesterday
is said to have been brought about
through a threat that the housing
code would be repealed in the event
the committee failed to agree to some
general plan of modification.
The committee is composed of L. K.
Bailey, Will Claussen. H. M. Easterly,
A. E. Doyle and O. D. Hughson.
