State Supreme Court licnies Rehearing-
of Case Wherein E.Mru Pay
ment Demanded.
SALEM, Or., July 15. (Special, t The
Oregon supreme court, in a decision
handed down here today, denied a re
hearing of the case appealed by Jack
son H'ounty from a decree in favor of J
John W. Sweeney by which he was j
awarded S2.u33.20. The same decree
held that the L'niced States National
bank of Portland was entitled to a
lien on the award to Mr. Sweeney in
the amount of $39.9ti.ro.
Mr. Sweeney, according to the evi
dence in the case, entered into a con
tract with Jackson county for the im
provement of the Pacifc highway ex
tending from the California line over
the Siskiyou mountains, a distance of
1 I miles. Before the contract was com
pleted Mr. Sweeney charged that the
county cha nged the location of the
road, thereby diverging from the terms
of the original agreement. It was
claimed by Mr. Sweervey that under the
contract he was entitled to additional
compensation for extra work, which he
charged was necessary when the loca
tion of the highway was changed.
Being unable to reach an agreement
with Jackson county, it wa stipulated
that the state highway engineer
should make an estimate of the amount
due Mr. Sweeney, but this award was
not satisfactory to the contractor. Suit
wa sthen filed in the circuit court by
Mr. Sweeney and h was given a judg
ment for $S".5n3.':. Jackson county
appealed the action, and th verdict
of the lower court was affirmed in
part. The decision denying a rehear
ing of the case was written by Justtoe
Bean.
