The six Circuit Judges, who have been sitting; en bano since last Tuesday, will be called upon to deter mine the validity of the Public Service Commission order of January R. which empowered the Portland Railway, Light A Power Company to charge cents for streetcar fares In the city of Portland. The closing argument in behalf of the street railway company was given by Franklin T. Griffith, president of the company, who consumed the greater portion of his time snswerlng the argument advanced last Friday by City Attorney La Roche. By quoting from numerous authori ties. Mr. Griffith argued that tbe act creating the commission is in every way constitutional. Rallaa- Held Administrative. i "Th act empowering; the Public Service Commission to fix rates o fares for street railways does not amount to a delegation of legislative authority, aa the act is the controlling feature." he argued. The act of the commission fixing the measure of charges which the street railway com pany may exact for fares is in th nature of an administrative act. whereby the existence of certain facts ascertained, upon the determination of which the statute regulating; such measures operates. In answer to the arg-ument that the franchise contract heretofore existing between th city of Portland and the Portland Railway, Light c Power Company Is Inviolable. Mr. Griffith contended that the city's charter did not authorise tbe city to make the franchise contract Inviolable, but If it did make such a contract, it was un alterable only so far aa the city was concerned, but not aa the state was concerned. Mr. Griffith further contended, and produced numerous authorities to sup port his theory, that the act creat lng the Public Service Commission gives thst body power to regrulate all rates which were in effect before came Into existence, without reference to time or manner of fixation. He con tended that the retroactive feature had no bearing; on . the referendum measur creatine th commission. Frederick V. Holman spoke during the morning session In behalf of the street railway company, consuming the greater portion of his time reading from legal authorltlea upholding; the validity of the commission's order in regulating the street railway rates. Attorney-General Browns argument was entirely a defense of the Public Service Commission, without reference to the Justice or injustice of he 6-cent fane. He read carefully certain sec tions of the set and showed wherein the commission Is empowered to fix rates on all public utilities. He cited the Woodburn telephone rase as one Oregon example where the State Supreme Court had decided that the commission had power to fix rates which had once been fixed by a munici pality. If this act of the commission should be declared Invalid and illegal, ha declared, it would mean that the Oregon Publio Service Commission would have lost its usefulness. It Is expected to be some little time before the six Circuit Judges review the various briefs which have been submitted and hand down a final de cision.
