1.
Receipts of grain were the heaviest vet
this -season, and corn arrivals at primary
centers were more than double last year-
figures. A further bearish factor was Pres
ident Wilson's proclamation disapproving a
higher guaranteed price on wheat. About
the middle ot the session, however, sent!

tended upward.
Oats paralleled the action of corn. There
was much short covering as n result of a
ruling at Minneapolis that settlement of de
faults would be based eomewhai on the value
oz casn oats In all markets.

A referendum vote on the 6-cent fare.
recently ordered by the State Public
Service Commission' and now in force
on the lines of the Portland Kailway,
Light & Power Company in this city,
is possible, according to contentions of
the city in its fight against the in
crease, and statements made at the
City Hall yesterday afternoon at a com
mittee meeting on another subject.
That the action of the State Com
mission in ordering the increase was
a legislative act upon tne part of its
members and therefore comes under the
provisions of the laws of the state re
garding the initiative and referendum.
is the declaration or JJan jvetianer.
Commissioner of Finance, who has been
ar-tivo In the fiarht against the increase.
City Attorney LaRoche and his staff
are of the same opinion, uut Jir. im
Roche declined to be quoted to that
effect at tnis lime.
This undoubtedly will develop, now
ever, as perhaps the strongest feature
ot the city's case against the increased
fare when it goes into court-
It will be the city s contention mat
the members of the State Commission
were in session on legislative business
whan thav directed the increase in
fares and that, therefore, under the
law. a referendum may be filed by the
people of Portland tne ones aiteL-ieu
within 90 days from the time such or-
rip, waa pnactpd.
There, is no Question In tne wona
ahnnt the law in this case," said Mr.
Kellaher. "The referendum applies,
most certainly. The act of the State
Commission was nothing more- or less
than a legislative enactment and
such. Is subject to review oj mo p.-"-Dle.
The law covers this point fully
and. I venture to say. If petitions were
to be circulated and the case should
go into court on that question, there
is no doubt of the decision.
City Attorney LaRoche reported yes
terday afternoon to Mayor Baker and
the members of the council that th
city's legal staff Is confronted by dif
ficulties, but,- as the city is anxious
for an immediate decision, will proceed
with the case.
