District Attorney Evans Advises Com
missioners ,Tbat. Basis of Case
Is Not Decided.
On advice of District Attorney
Evans, the Board of County Commis
sioners yesterday, denied the petition
of County Clerk Beveridge for the
transfer of $15,522.43 to make up the
K. 6. Field deficiency In the liti
gants' deposit fund, despite th recent
decision of the Supreme Court direct
in? such disbursement.
As a result a new mandamus action
will be prosecuted by County Cleric
Beveridg-e.
The refusal to transfer the money
was due to legal technicalities which,
if unsettled, might, in the opinion of
Mr. Evans, make the County Commis
sioners and County' Clerk personally
responsible for the money taken from
the general fund for this purpose.
A lengthy opinion submitted to the
Board by Mr. Evans yesterday re
viewed the mandamus action . brought
to determine responsibility for the pay
ment to litigants of the funds lost by
ex-County Clerk Fields through de
posit of county funds in a private ac
count in a bank wbich failed.
This opinion recites that the Supreme
Court decision of January 2, 1917, does
not settle the basic question. It clear
ly directs the disbursement of county
money by warrant to be issued by the
Commissioners, but the fundamental

disburse moneys of the county for thel
purpose indicated is as unsettled as
heretofore. In the opinion of Mr. Evans.
It is pointed out further that there
is no money in the county treasury
now which could be diverted to cash a
warrant for $15,522.43. and that there
was no hope that any of the persons
who would receive the money would
benefit before 60 days, whereas the
former mandamus action only occupied
a month's time.
Steamer Maryland Missing.
WASHINGTON. March 22. The
steamer Maryland, of Milwaukee, Phil
adelphia to London, has been posted by
Lloyd's as missing, according to State
Department advices today from Consul
General Skinner at London, No details
were given.

PERRY EXPEDITION EXPERIENCE

History was- recounted Wednesday
night by a man who had a part in mak
ing it when Captain W. H. Hardy, sur
vivor of the Perry expedition to Japan
In 1853, told of his experiences to a big
crowd in Library Hall
Captain Hardy told with a wealth of
detail of the voyage to Japan, then a
nation closed to the outside world, and
the signing- of. a treaty that forced the
opening of commercial relations. He
was bow oarsman in the barge that
took Comodore Perry to and from the
shores of Yeddo Bay, Japan, while his
flagship, the frigate Mississippi, lay
anchored there.
It was in 1852 that the Mississippi,
with young Hardy, a blue Jacket, in
her crew, sailed from Norfolk for Japan.
The trip was made by way of Cape of
Good Hope, with many stops en route,
so that it was in the Summer of 1853
that the arrival was made in Yeddo
Bay. The treaty that forced commer
cial relations with the United States
was signed on March 31, 1S54.
Chairman H. B. Miller spoke briefly
of the admirable qualities of the Jap
anese. William D. Wheelwright gave
an eloquent greeting to Captain Hardy,
and S. Akamatu, Japanese Consul,
spoke of Japan's awakening- following
the visit of Commodore Perry in 1853.
Lieutenant-Commander J. H. Black
burn, in charge of the naval recruit
ing stations here, introduced Captain
Hardy. There were instrumental num
bers by the Weber Juvenile Orchestra
and songs by the Veterans' Quartet.'
WARNING IS GIVEN-CHINESE
"Old Billy," Restaurateur, Fright
ened by Death Notice.
Trepidation claimed "Old Billy," kindly
Chinese cook and partner in House's
restaurant. 1284 Third street, when a
countryman called him by telephone
yesterday and announced that he was
slated to be the next victim of the
tong war.
Police protection was requested, and
Captain Inskeep. detailed a patrolman
to duty In the restaurant until the
source of "Old-Billy's" fear was found.
Detectives assigned to the case by Cap
tain Baty reported that the alarm arose
from the constant parade of an elderly
Chinese, before the restaurant, who
appeared to be wholly harmless.

lege, Pullman. A pen of White Leg
horns belonging to J. A. Hanson, of
Corvallis. heads the list with a total
of 299 eggs laid, while a pen of the
same breed belonging to the Oregon

test has run four and a half months
