TITE MORXING OREGOXIAX, WEDNESDAY, JUSTE 21, 1916.
CANAL IS STILL OPEN
Two Feet More Would Close
Cascade Locks.
18 INCHES IS PREDICTION
Minor Damage on Waterfront Is
. Done by Kiso and Approach to
Ainsworth. Dock Is to Be
Weighted With Car Wheels.
Based on yesterday's reports of the
stage of water at the Cascade Locks
It is estimated that the canal there
will not be closed to navigation unless
a rise of two feet is experienced. Gains
registered at Wenatchee, Lewiston and
Umatilla for 24 hours ending1 yesterday
morning are calculated to bring the
river up 1 feet at the Cascades.
As the steamer Twin Cities has been
tied up because of the freshet, having
arrived from Lewiston on her last trip
Monday, no concern is felt for the
Celilo Canal, which would probably be
difficult for steamers to work through
at present.
Between 8 A. M. and 4 P. M. yester
day the river here gained four-tenths
of a foot, standing at 20.8 feet, and
JJistrict forecaster Boals expects it to
so to 21.3 feet today, 22.1 feet tomor
row, 22.8 feet Friday and 23.2 feet Sat
urday. The most marked rise recorded
in yesterday's , advices was at The
Dalles, where i.6 feet was reported,
the stage being 36.4 feet and the flood
stage there is 40 feet.
Mr. Beals says cooler weather un
doubtedly will have an influence by to
day on the freshet, and virtually no
rise is expected to be shown on the
Snake River, in which event the Upper
Columbia will probably be at a stand
still. At some places on the waterfront
minor damage has been done to dock
roadways in raising tho planking. At
Ainsworth dock it became apparent yes
terday that weights were needed to
keep the upper roadway intact, so It
was arranged to obtain old carwheels
And other railroad material to place
Along the upper approach.
In the rear of Ainsworth dock tracks
are flooded, there being about three
feet of water on the lower level of the
dock, and the track grade is much
lower. Railroad freight brought from
California on the steamer Rose City
was discharged yesterday at Albina
dock, wbers the steamer shifted at
noon.
COQUIIXE INSPECTED TODAY
Xntest Acquisition to Shaver Flag to
Be Gotten Ready for Towing.
Being prepared for service, the tug
Coquille, purchased a few months ago
by the Shaver Transportation Company
on the Coquille River, is to be inspected
today under the direction of Federal
Steamboat Inspectors Edwards and
Wynn. The steamer Henderson, of the
name fleet, is also due for inspection.
The inspectors began their annual
scrutinization of the steamer Woodland
yesterday.
The steamers Shaver, Cascade and
Henderson left last night for Wallace
Slough, where they will take in tow
the first cigar-shaped log raft of the
season, which is to be towed to San
Diego, The tug Hercules, which ar
rived at Seattle at 8 o'clock yesterday
morning from Astoria with the dredge
Long Beach, sailed an hour later on
her return to Astoria, where she will
pick up he big log raft and head
down the Coast.
DUTY OX SHOVELS QIIESTIOXED
Line as to AYhether Tools Are Agri
cultural Implements Fine.
If shovels are admitted to the United
States as agricultural implements no
duty is collected, but as some are used
for street cleaning and other purposes
the question has been raised as to the
classification, and that was one of the
subjects on which evidence was heard
yesterday at the Custom-House by S. B.
Cooper, of New Tork, general appraiser,
and J. J. Mulvaney, Assistant United
States Attorney. They are accompanied
by Fred J. Carter, stenographer.
Testimony was taken at length at
San Francisco on the same feature and
the officials left last night for Seattle
to conduct a hearing. A decision will
be reached after their return to New
I'ork. Other cases are being considered
at the various ports as well, all having
to do with the classification of im
ports. liKAR'S TKXTE FOS1TIOX NOTED

Bearings taken by Captain Oliver P.
Kankln, master of the steamer Rose
City, as that vessel passed the stranded
steamer Bear, her fleetmate, show the
latter to be ashore three-quarters of a
mile south of the mouth of Bear River
and 1 k miles north of Blunt's Reef,
not on Sugar Loaf at the inshore end
of Blunt's Reef, as has been reported.
The Rose City, which arrived late
Monday night from California ports.
passed the Bear about five miles away.
the course of the Rose City being out

6HIF CARPENTER CONVICTED
Cliarlcs May in Jail in Astoria for
Bootlegging.
ASTORIA, Or., June 20. Special.
Charles May, ship carpenter on th
steamer Northern Pacific, has been ar

The steamship officers have been sus
picious for sometime that some mem
ber of the crew was bringing liquor
from California and selling it. Accord
ingly a strict watch was set and on
Sunday May was detected selling five
bottles of whisky to a soldier named
Downs. The latter was caught with
the liquor on his person, but he was
released.
This morning. May was brought to
this city and upon being arraigned in
the Justice Court he pleaded guilty to
a charge of selling liquor. He was
fined $150 by Justice Carney and is now
in the County Jail, but says he will
send to San Francisco for money to
pay his fine.

Ending another of her fishing cruises the
gasoline schooner Decorah entered the Co
lumbia River yesterday afternoon.
Good time was made down the coast by
the "Big Three" flagship Beaver, Captain
Mason, which left here at 3 o"clock Sunday

VERDICT AGAINST CITY
PROPERTY OWERS WK SUIT FOR
DAMAGES AT MARSHFIELD.
Drain Through Fill Clogs ITp and Hold
ers of Flooded Land Are Award
ed f 100O by Juries,
MARSHFIELD, Or., June 20. (Spe
cial.) A decision was rendered by a
jury in the Coos County Circuit Court
in the suit brought by property hold
ers who claimed to havo been damaged
to the extent of $36,000 by the dredge
fill in the city of Marshfield. and the
court entered an award of $200 dam
ages. A previous suit gave the prop
erty owners $1700, making a total of
$1900.
The case was brought jointly against
the city of Marshfield and the Port of
Coos Bay and was defended by City
Attorney J. T. Brand and Port Attor
neys J. W. Bennett and C. R. Peck.
Stoll & Hodge, of Marshfield, repre
sented the property owners.
C. A. Johnson and others owned a
tract of 25 acres in the western part
of the city in the form of a basin and
tidelands, with a stream traversing It
from west to east. The Port of Coos
Bay obtained permission to close the
stream, which was termed Mill Slough
and navigable to Ninth street for small
boats, such as pleasure launches.
The closing of the slough and the fill
ing of 120 acres of land in the Marsh
field city limits were dependent upon
each other. Property owners as far
west as Tenth street signed for the fill.
A drainage system provided an outlet
for the water, which crossed the 25
acres in question, but this permitted
the fine sand from the bay to sift
through and block the discharge. The
water coming from the gulch flooded
the 25 acres owned by Mr. Johnson.
Neither the city nor the Port would
assume responsibility for damage, and
the suit resulted.

OAKS PARK
Chat No. 42
DID it ever occur to you that
"all work and no play makes
Jack a dull boy"? When you want
to make your eyes sparkle and
your fingers tingle, when you want
to feel like a regular kid again,
you ought to try a day, an after
noon or an evening at the Oaks.
It's Coney Island for the North
west; has just as much thrill as
the real one and abounds in pleas
urable recreation. Suit yourself
from shooting the chutes to hear
ing the Columbian Ladies' concert,
there isn't a disappointment in the
park.
By the way, a big programme
begins tomorrow afternoon. Miss
Alice J us ton, a stunning young
contralto, with an unusual voice,
has but recently been engaged
here. She's going to sing the pop
ular and old-time melodies as she
alone can. Then there's Glenna
Delgado, who's most fascinating
Egyptian 'dance will be presented
both afternoons and evenings. The
Big Four Quartet and Tine and
Edwards are additional attractions.
Come and join the merry throng
of picnickers who are enjoying the
Oaks daily. Reservations for large
or small parties may be mark: by
telephone. Bring the kiddies along
they'll be wild about Punch and
Judy, the swings, the monkeys and
the bunnie and bears. A day of
fun will make you so hungry you
can hardly wait to spread your
luncheon in the pleasant shade of
the great oaks. Give your coffee
to the maid in the kitchen and she
will make it for you. Any number
of clubs, associations and state so
cieties are having their annual
picnics at the Oaks this Summer.
A number of Portland little folks
are becoming ideal hosts and host
esses by bringing their guests and
parties to the Oaks, where all of
them can have a heap of fun. 'Lit
tle ones under five are admitted
free and the other children go for
half fare.
Swimming is fast becoming the
great American Summer sport.
Devotees of aquatics delight in a
swim from the new Oaks bath
house. An invigorating plunge in
the beautiful Willamette insures a
keen appreciation of the whole
day's activities. Cars leave town
for the Oaks from Second and
Alder every few minutes and
launches at frequent intervals.
