Adv. Defense of A. C. Warrlner, Charged With Knnning Down Woman on Highway, Contends Crime Is Xot Specified. The question of whether the indict ment against A. C. Warrlner, who, as a result of having run down Mrs. Al- freda Beckman with his automobile on the Columbia River Highway Sun day, April 9, Is charged with assault with a dangerous weapon, sets forth sufficient facts, was argued before Cir cuit Judge Morrow ln the Circuit Court yesterday. Judge Morrow announced that he probably would hand down his de cislon this morning. John F. Logan, attorney for the de fense, contended that the Indictment was not specifically sufficient, in that it failed to set forth how an automo bile, not inherently or by common use as such, could be construed as a dan gerous weapon. He declared that the ndictment should specify how the au tomobile on that particular occasion was a dangerous weapon. State Opposes Contention. Deputy District Attorney Hindman, who is handling the case for the state. declared the question of how the auto mobile in that specific instance can be construed as a dangerous weapon Is a matter for proof rather than one of charging. He declared that it was a subject which should be properly taken up ln the testimony and not in the in dictment. He referred in his argument to ordi nary assault and battery cases, saying that it is enough In such Instances to merely charge the defendant with as saulting and beating and unnecessary to explain tne circumstances of the action. Assault with a dangerous weapon cases he declared to be similar and contended that sufficient facts were brought out to constitute an in dictment against Warrlner, I,w I Quoted. In substantiating his argument Mr. Logan quoted the law governing the required contents of an indictment, as follows: "The particular circumstances of the crime charged when they are neces sary to constitute a complete crime Ana also A statement of acts constituting the offense in ordinary and concise lan guage Deputy District Attorney Hindman announced that, in case the judge should uphold the demurrer, the state immediately will issue an order re submitting the case to the grand iurv on an assault and battery charge. ine accident which resulted in the arrest of Warriner occurred one mil. beyond Crown Point, on the Columbia Klver Highway.
