It begin at the north line of Russell street at Delay street and ends at the south line ff Killtng-aworth avenue at Greeley street. 2. What will be the entire cost of right of way therefor? The estimated cost is $113.7166. ::. What is the law with reference- to easements if such are require!? The anwf-r to this question. Is given in the City Attorney' report to the Council relative to thu e?.U;n5ion part of. which I junte: "It is our judgment under existing pro visions of tho charter that the city should first acquire the rijfht of way. and after wards, when an improvement is made, ac quire the easement to make such slopes as may b then found to bo needed." i 4. What is the estimated amount of yard age, and what is the probable cost of ex cavation ? I would not recommend paving until thoroughly satisfied tnat all embankments had ceased to settle and the roadway was in a stable condition. This would mean a period of from one to three years, or pos s.bly longer, aftr grading had been finished. .. What Is the boundary of the district and the numoer of lots to be assessed ? The boundary of the district is published in the city official paper in detail, and is too long a description to copy in corre Bponnc. Ther are approximately 2989 acres within the district, and applying the factor of six hits to the acre would give & total of 17,934 lots 50x100 feet. What is the probable cost per lot for the whole, including paving ? To answer this question direct would give a wrong impression, as the district that is assessed for the acquiring of necessary right 'f way is much larger than the district that will be assessed for the improvement, as the benefits received from street extension re of somewhat different nature than those received from construction and paving. For your information, however, I will say that if each lot (assuming there are 17,934 lots) was assessed equally, the assessment for the street extension proceedings would be $6.34 per lot, provided the proposed vacation of the St. Johns road was not considered. Average Assessment $4. Should the Auditor in making the assess ment consider the vacated area of -the St. John's road a benefit in like proportion to t he land taken through which the exten sion passes, the above assessment, of $113, would be reduced by approximately $40,- (io.t. This reduction would make an average as sessment of $4.11 per lot in lieu of $6.34 per lot. 5. What, if any. intersecting streets are contemplated to be conocted up with said Greeley street extension and when ? There are no streets now under considera tion to be connected with this extension, but should the property-owners so elect, the fol lowing streets can be conected without ex cessive srades or cost: Emerson street, Sum ner street.. Alberta street, Humboldt street, doing street, Penn street. Maryland avenue extension, which was con torn plated some years ago, would also connect with this extension. 9. Has the city any authority to compel the streetcar company to build a carline on this street? The answer to this question Is more a matter of law than engineering and should he answered by the- Railroad Commission of Oregon. My impression is that the city has no such authority. JUDGE CAN'T HEAR CASE ORDER ISSIED IV SI IT AGAINST LIFE IXSIRAK'B COMPANY. Trlnl of ?so,000 Action, Charging Dis sipation of Assets. Awaits Su preme Court Decision. The suit of X. TV. Rountree,, receiver for the defunct American Life & Acci dent Insurance Company, against for mer officials of that company and the heads of the Union Pacific Life Insur ance Company, charging a conspir acy which resulted in the loss of 80, 000 of assets to the American Life ftonlcholders, will not be held before Judjre Gatens today, as scheduled. An order from the Supreme Court, enjoining Judge Gatens from trial of the case, was received yesterday. The injunction will not be lifted pending the settlement of the Supreme Court on the appeal of a companion case filed l'y N". Whealdon and other stockhold ers in the defunct company against the same defendants. The petitioners in the Supreme Court have represented that the same issues are involved in the suits and that the one brought by ilr. Rountree is a friendly affair. Attorneys Duniway and Whealdon were refused permission by Judge Gatens to frle an "amended complaint in their suit against the insurance officials, or to file an amended petition in another action in which it was sought to depose Mr. Rountree as re ceiver. Both cases were appealed to the Supreme Court from these refusals. Judge Gatens has held all along that tho stockholders are not the proper parties to bring the suit, but that the action should be brought through the receivership. The original plaintiffs have contended that they fear they would not get. a fair deal if the re ceiver brought the suit. CARD OF THANKS.
