To compel the deliverr of 24 bottles
f beer to his keepinjc as a common
carrier. Rudolph 'Wilhelm. of the Vv'il
lielm Transfer Company, yesterday ob
tained a writ of mandamus against the
Southern Pacific Railroad, which will
be argued before Circuit Judge Havana-Jen
next Wednesday. This will be
the first test case in Oregon of the new
ciry amendment.
Attorney-General George M. Brown
has been requested by District Attorney
Kvans to be present during the hear
ing as a friend of the court.
The bottles of beer in question are
from San Francisco and are consigned
to J. P. ltyan. of 65 North Ninth street,
"in care of the Wilhelm Transfer Com
pany." The t-outhern Pacific Company
refuses to deliver the goods to the
transfer company on the grounds that
it has no right to do so under the law.
It contends that the liquor must be de
livered direct to the person to whom it
is consigned.

!r. Wilhelm maintains that he has
necessary affidavits and that tho
"booe" is routed by him, and that the
transfer company is as much a common
carrier as the railroad.
Most beer shipped into the state has
come by freight and has been delivered
direct to the consignee. There is no
question of the legality of this proceed
ing. Now comes beer shipped by way of
another common carrier, the transfer

risht of the railroad under the law to
turn the liquor over to anyone but the
person to whom it is billed.
District Attorney Kvans Is deter
mined to fight the right of railroads to
deliver consignments of liquor to trans
fer companies and Jitney drivers, wun
nnt amnle check on such operations.
This check would appear to be fur
nished bv the necessity that such de
liveries be made only when originally
consigned by way of the common car
rier to whom the railroad turns over
the liquor.
Only Freight Shipments Affected.
The question'ls only raised on freight
shipments. Wines, cordials, etc., are
chieflv shipped through express com
panics which handle the consignments
from the consignor to consignee, ana
the question of delivering the liquor
into the hands ot a second party does
not arise.
The point on which the transfer com
pany is making its stand is that it
is no more Illegal to send liquor by
way of several different railroads, and
possibly a steamship line, as freight, to
be delivered direct lo : the consignee.

The point raised is not specifically
considered in the amendment. Attor
ney-General Brown has defined a com
mon carrier as "an express company, a
railroad, streetcar company, stage line,
auto delivery line and dray; but not
a private individual, unless wholly en
gaged in hauling freight or passen
gers, or both, for hire." This would
include Jitneys.
FORMER LAWYER INDICTED

Cliarged With Fraud.
SEATTLE. Wash.. Jan. 20. George P.
Rossman. a former lawyer of Seattle,
who was disbarred several years ago,
was indicted yesterday by the Federal
grand Jury on charges of using the
mails to defraud persons in the locat
ing of lands in Canada.
Itossman. who was acrested several
months ago and released on bail, wai
reported to have gone to California
where, it is understood, search is being
malc for him by his sureties In an ef
fort to surrender him to the authorities.
The indictment charges that, under
false representations, he operated
realty offices for the sale of Alberta
lands in nearly all the principal cities
of the Pacific Northwest.

motion pictures in Portland is to.be
proposed to the City Council by Com
miffsioner Daly. He announced yester
day that ho will prepare an ordinance
as soon an he lias nude inquiry into
the systems of Eastern cities.
The police, or some other authority
may be empowered to make arrests for
exhibiting pictures which are barred.
ComminsionT Daly will meet this
afternoon with a committee represent-
ina the motion picture interests. Mr.
Daly says he hopes to be able to gret
his new ordinance ready in the near
future.
