California grant lands la the courts for
years Is threatened as a result of the
decree handed down in the United
Mates Court yesterday by Judge oi
verton In the case of the Government
against the Southern Oregon Company.
The court held, in this decree, that
the grantees of the land are entitled to
a value of J;. SO an acre and no more.
Attorneys for the defendants gave no.
tlce of appeal.
A similar decree, with substantially
the same provisions, has been prepared
by Constantino J. tsmyth, special assist
snt to the Atlomey-Oeneral of the
I'nited States. In the Oregon c Califor
nia case, which decree will be sub
mltted to Judge Wolverton this morn

Attorneys for the Southern Tsclfic
Compeny. who contend thst they, as
present holders of the Oregon ft Cal
ifornia Isnds. own the timber, coal,
miner. la and other natural resources.
as well as their value of 12.50 an acre.

If tha court accepts the contentions
of the L'nlted State attorney, aa It did

peal. Hoth these appeals must go to the
Cm ted Stat. Circuit Court of Appeals,
from which It will be possible to ap

Court. Thus It Is possible that the
lands will be held in litigation for a
lone period.
The decree signed by Judge Wolver
ton yesterdsy enjoins the Southern
Oregon Company from selling- any 01

road lands, "or any minerals or other
deposits thereon, except as part of or
in conjunction with the land on wmcn

from cutting or removal of any or tn

In brief, the title of tha defendants
In the property was upheld, but they
were required to sell, avhen they did
sell, for K.50 an acre. They were en-
Joined from selling- at all, however.
until Congress could specify the terms
of the sale.
Mr. Smyth was retained by the De
partment of Justice to prepare a de
cree In accordance wtin tne supreme
Court's decision. His Interpretation of
the decision Is thst the grantees are
entitled to nothing more than 12.60 an
acre In their holdings.
This Interpretation does not coin
cide, however, with the interpretation
of the attorneys for the grantees. Con
