The Supreme Court today. In an opin
ion by Justice Burnett, upheld, an or
dinance enacted by the residents of
Portland in 1911 providing for the levy
ing of a license tax on the "gross re
ceipts of persons and. corporations sell
ing gas, natural or manufactured, for
lighting, heating, fuel, or other com
mercial purposes' The Portland Gas
& Coke Company declined to pay the
tax. 3 per cent of gross receipts, de
claring mat it was an attempt at
flouoie taxation. Circuit Judge Gatens
sustaining its oemurrer to the com
plaint. Its franchise haviner been taxed
as real property, the defendant averred
that it could not be subject to another
tax. ine opinion says:

licenses with the object of raising

ferent from saying it had a right to

Tax Held Permissible.
"The right of the defendant cor
poration to do business at all in the
city is referable to the franchise to
be a corporation, for, without that
portion of its grant giving it Identity
as an artificial being. It could not en-
rraga in any transaction whatever. It
s quite as permissible to impose
an occupation tax upon this con
ventional personage for the privi
lege of doing business in the city as
it is upon a natural individual engaged
'in the same or similar enterprise."
