HURLBURT STILL GAINS Judge Kavanaagh Will Decide Some : JJisputed Voles Today, but It lb ot Considered Likely Pre cinct 31 Will Be Reached. Evidence that 123 ballots in Pj-ecinct 7 were tampered with and the Bhriev alty votes changed in favor ot Tom M. Word, will be laid before District At torney Evans today, and if the evi dence is deemed sufficient Mr. Evans will present the case to the grand jury tor a thorough investigation. . The ballots on which erasures were made are sealea now and In the pos session of Circuit Judge Kavanaugh, who will be called upon to decide whether they shall be counted in the election contest of Mr. Word against Sheriff Hurlburt. Until he has ex amined the ballots. Judge KavanaugH will make no statement. It was at first the intention of Dis trict Attorney Evans to take no action on the irregularities in Precinct 37 un til Judge Kavanaugbs decision was handed down. Public discussion of the erasures revealed was so strong yester day, however, . that he determined to The total number of alleged fraudu lent ballots was increased to 123 yes terday morning, when the small ,box containing ballots rejected by the nignt board was opened and found to contain 71 instead of 6&. as was stated on the label outside. AantasooiKna I" SnKpected. Out of a total registration of 330 in Trecinct 37 there were 2u0 votes count ed for Mr. Word. 55 for Mr. Hurlbur, and 71 were rejected. This total of 32 1,-aves only four possible votes to be divided between Lull and Newman, tne lllllltliiilttl other two candidates, ana umu. of which there were usually quite a number in other precincts. It de clared probable, therefore, that totes cast for Lull or Newman were changed to Word votes, and also that blanK ballots might have been marked for Vn his contest complaint Mr. Vford alleges that he should have received 311 votes in this precinct and Mr. Hurl, hurt 19. This leaves no votes for tne other candidates. . This assertion in the complaint is made in a precinct filled with hotels and rooming-houses, many of which .Mi- Word, as "reform Sheriff. had raided. Precincts nearby where there xre also numerous hotels and rooming bouses, went strongly for Mr. Hurlburt. During his term in the Sheriffs office Sir Word had conducted a vigorous campaign against some of the rooming houses in this precinct, and pre-election forecasts of his supporters had conceded that entire district to Mr. llurlburt. Mr. Hurlburt gained 17 vot-s by the recount yester day Including a number of disputed ballots which will have to go to Judge Kavanaugh for decision. llurlburt supporters declare they are votes ahead of the official count since the beginning of-Mr. Word's re count. Because of disputed ballots, however, these figures are not final. "Mr Hnrlbtirt gained a few today in the counting." said Mr. Farrens the Word attorney. "1 think on the whole we arc about even on the. recount date." BALLOON PILOT PLAINTIFF Jolin 'Watts Sues for Prize Money In Itiw Festival ISacc. John Watts, balloon pilot, demands his first prize money for winning the l.illuon race during the Rose Festival last year, in a suit against the Kose festival Association filed in County ClTk Coffey's office yesterday. The ruit is said t. be a friendly one, brought because of the refusal of the Aero Club of America to qualify Watts entrance in the race, the object being to enable the Kose Festival Association to avoid further suits by other com petitors after it shall pay the money to Watts. " Watts in his balloon went a distance of S2.75 miles, coming down in the woods of Lane County. He was ac companied on bis trip by Koscoe Faw- I. The race was conducted under the auspices of the Aero Club of America, however, and because Watts had failed to post $50 forfeit for his appearance for the race, the club authorities, after the race was over, disqualified him. IRRIGATION GRANT IS URGED Commercial Club Coiiimlltee Favors 8430,000 Appropriation. A resolution favoring a appropria tion of $450,000 by the Legislature for Irrigation hus been adopted by the spe cial committee of the Portland Com mercial Club appointed to support the legislative programme of the Oregon Irrigation Congress. The resolution points out that the appropriation Fhould be expended in conjunction with the Government's appropriation of like amount, but that if the Government fails to appropriate money for Oregon irrigation work, the amount should be expended independently.
