QUICK DECISION PROMISED Procedure to Be Taken by District Attorney Evans Under Law Oov--;' ering Usurpation or Orfice. Ballots Not Changed. ' Legal proceedings in the nature of a Quo warranto action will be filed in the Supreme Court this morning and argued this afternoon to determine the legal status of Judge Cleeton and County Commissioner Hotman. The ac tion is brought by District Attorney Evans and is a friendly suit under sec tion 366 of the state laws to prevent usurpation in office. A decision is promised by the Supreme Court this week. Mr. Evans will argue for the state and Judge Cleeton will repre sent himself, while E. E. Coovert will appear for Mr. Holxnan. Meanwhile Judge Cleeton Is trans acting no business either in Probate or Circuit Court. He went to Salem yes terday to learn direct from the Supreme Court what his action in future shall be in respect to holding either court. Commissioner Holman was advised yes terday by District Attorney Evans not to cast the deciding vote rn any cases coming before the County Commission ers pending the settlement of the suit to be filed today. He will, however, act on routine subjects, as usual, where bis vote will not change the decision of the Board. The theory of District Attorney Evans in filing the information is that Judge Cleeton is chairman of the Board of County Commissioners and that Mr. Holman Is not entitled to sit with that bodv. County Clerk Coffey will make no chanse in the form of the official bal lots now being printed unless he is directed by a court order to do so. They will issue in the form originally iixea, bearinz the name of C. U. Gantenbein aTid Rufus C. Holman, even though the Supreme Court decision appears to de clare there is no Department 6 of Cir cuit Court, for the judgeship of which Mr. Gantenbein is a candidate, and leaves the status of Chairman Holman, of the County Commissioners, in an uncertain state. LINE MAY LOSE FRANCHISE District Attorney to Ask Revocation or liinnton Privilege. District Attorney Evans says he will recommend to the County Commission ers that the franchise of the United Railways Company on the Portland-St, Helens road between this city and Linn ton be revoked. He holds that the traction company promised the county that a fare of S cents would prevail and that the fare has been increased to 10 cents. The railway company contends that the State Railroad Commission has the power to fix rates and has given au thority to the company to charge the 10-cent fare. At the request of C. H. Carey, coun sel for the United Railways, the County Commissioners yesterday postponed action on the Linnton petition for one week. FAKE COINS UNEARTHED fcchoolboy Finds Counterfeited Pieces at Oregon City. OREGON CITT. Or., Oct. 21. (Spe cial.) A collection of 20 poorly-counterfeited five-dollar gold pieces was picked up along the railroad yards "Wednesday afternoon by Paul Butter worth. a pupil of the McLoughlin School. The coins are of lead, about the same weight as the regular gold piece, bear the goddess head on one side and the shield on the other. The word 'Five is distinguishable, with the date and the words "United States of America." The gold leaf of paint covering was well worn off on most of the pieces. It .Is possible the money was thrown away by some one of the 25 tramps rounded up Tuesday night by the police. SAMPLE BALLOTS READY Voters to Receive 50,000 and Elec tion Officials 136,000. Sample ballots to the number of 60, .000 were received from the printer by County Clerk Coffey yesterday and are now being distributed to voters. They are available for those who call for them, the idea of the distribution being to give one to every family. There will not be enough of the sample ballots to provide one for each voter. An additional 136.000 sample ballots will be distributed to election officials at the various voting places prior to the election for use at the polling places throughout the county. Official ballots now are being printed and will be sent to the various election pre cincts beginning next Tuesday. Gresham Girls' Quintet Seeks Games The girls' basketball team of the Gresham High School has organized for the Winter season, with Miss Gertrude Leggett, teacher of the seventh grade, as coach. Miss Hester Thorpe has been elected manager and is' in corre spondence with the teams of the fol lowing towns: Silverton, Oregon City. Canby. The Dalles, Hood River, Steven son. Astoria, Rainier, St. Helens, St. Johns. Estacada, Springwater, Vancou ver, Camas, Washougal, Orient. Port land Girls' Trade School, White Salmon, Kelso, Ciatskanie and Hillsboro. If all these towns accept there will be 42 games, including the return games. It is expected there will be a game every J! riday night. Flreboats Nearly Collide. . The fireboat Williams, which had been put into commission while th David M. Campbell was down the river fighting the flames on the ship Santa Catalina. nearly was rammed last night when the Campbell returned and headed Into her slip before it was noticed that the Williams was docked there.
