S. f'Ren will have the Indorsement and active support of the Prohibition party in his race for Gov ernor, or whether the Prohibitionists will nominate a new candidate for Gov ernor, now that Mr. U'Ren has defi Jtitely bolted the party fold. Is to be decided within the next few days by Prohibition leaders through the state Mr. U'Ren, In a formal letter of ex planation yesterday, told his reasons for declining the Prohibition nomlna tlon. which he had previously accepted at the Prohibition party state conven tion here. "I think that Mr. U'Ren will find the Prohibition party can do without Jalm a good deal better than he can do without the Prohibition party," was the comment of J. Sanger Fox, office sec retary at Prohibition headquarters after Mr. U'Ren's letter had been read yesterday afternoon. "Of course, he has the right to drop the Prohibition nomination If he sees lit, and to run as an Independent Whether warranted or not, there seems to be rather a widespread feeling among the rank and file of the Prohi bition party that In so doing, however, Mr. U'Ren has not done exactly the plpht and square thing by them." Mr. Fox added that letters bad been written to members of the Oregon Prohibition state committee and to the chairmen of the various county com mittees asking whether they favored cupportlng Mr. U'Ren or nominating a new candidate for Governor. Curtis P. Coe, of McMlnnvlIIe. Prohi bition nominee for Congress from the First Congressional District, said he thought Mr. U'Ren was sincere in his action. Mr. Coe added that he person ally intended to vote for Mr. U'Ren, but that even If it should be decided to grive him the Prohibition party indorse ment, he will not have the united and active backing that otherwise he would Iiave received. I Explain Stand. Ernest E. Taylor, state secretary of the Prohibition party, was not in Port land yesterday. Mr. U'Ren's letter follows: Oregon City. Or., July 27. To the Mem bers of the Executive Committee of the Prohibition Party of Oregon. Mr. Ernest E. Taylor, Secretary: Please accept this let ter as my resignation of the Prohibition party nomination for the office of Governor of Oregon. I am advised by Secretary of State Olcott that a law passed by the last legislature does not permit an Independent candidate for public office to accept a po litical party nomination. When I wrote my Independent declaration against the liquor traffic last February, 1 bad no thought of being honored with the Prohibition party nomination. When asked ff 1 would accept that nomination. If it was offered. I answered yea. It waa clear that your party nomination probably would unite the "dry" forces and Increase my vote. One of my reasons for being a candidate was, and is, the desire to be elected. I have al ways had the warmest admiration for the sincerity and self -sacrificing enthusiasm of the members of your party, and naturally was pleased with the prospect of their sup port. But I cannot consistently accept the Pro hibition name and nomination exclusively, because I am first an Independent. At the party convention in May it was made very clear from the platform that my candidacy mm an Independent waa to precede the Pro hibition party designation on the ojtlclal bal lot. The delegates were clearly satisfied that this should be so. I believe I can do more effective work for the Oregon dry amendment and other measures that I con alder of very great Importance to the peo ple, by continuing as an Independent can didate, rather than by becoming the can didate of the Prohibition party alone. Tor the reasons stated I must restgn your party nomination, but I hope and be lieve we may work together and rejoice next Xovember over the adoption of both the Ore gon dry and proportional representation amendments. Smith, Demo cratic candidate for Governor, in re sponse to two open lctetrs previously written by Mr. U'Ren. In his letter yesterday Dr. Smith bald: Portland. Or.. July 27. Hon. W. P. U'Ren. Oregon City, Or. Dear Sir: Your recent pen letters asking what position I expect to take on Prohibition are hereby acknowl edged. Shortly after receipt of yeur first letter I was approached by the Anti-Saloon League and asked to enter Into an agreement, to gether with other candidates and the party leaders, to keep the campaign for offices separate from the dry campaign. Victory in No vember will be only half the fight for a dry state. Very truly yours, C. J. SMITH. FRAUD PLOT IS CHARGED Investor In Hillsboro Business Seeks to Kecover $1000. Alleging a conspiracy to defraud him of $1000, suit to recover that sum from J. W. Cook, E. L. Clark and Edward Schulmerick, of Hillsboro, was started yesterday by Fred Schmidt. It is charged by the plaintiff that he was induced to Invest in the capital stock of the People's Store Company, of Hillsboro, through the false representa tions of Cook and Clark, who operated the store and held out inducements to him of Its condition and prospects. Edward Schulmerick, who is named as president of the Hillsboro Com mercial Bank, is also blamed by the plaintiff in that Mr. Schulmerick is said to have given a letter to the store managers in which he testified to the condition of the books and stated the institution was in splendid shape fl nancially. It Is charged in the complaint that the contrary was true. BERNARD SCHMIDT LOSES 3fan 'Struck by Attto Gets $100 and Judge Thanks Jurymen. Bernard Schmidt yesterday was as sessed 1100 damages In the District Court by Judge Jones in favor of D. H. Lemaster, who brought an action against Schmidt because he was struck bv the latter's automobile on Corbett street. The automobile owner, it appears had repulsed an accident insurance agent who sought to safeguard him against Just such mishaps only the day before the collision and the fol lowing day ho signed up for about all the automobile Insurance he could carry. In the trial of this case, Judge Jones took occasion to thank the Jury men for their promptness in returning right after lunch to conclude the hear ing. SALOONIST JS ACQUITTED Jury Frees Lundgren of Charge of Selling Liquor to Minor. A jury in the Municipal Court yes terday afternoon acquitted Charles Lundgren oi a charge of selling liquor to minors. Percy Velleux, who says he is 19 years ol'" declared he had bought liquor from Lundgren in the saloon at N'o. 1 North Third street. Doubt was expressed as to Velieux's real age. "Do you know the defendant In this action?" Deputy City Attorney Stadter asked one of the Jurymen. "Do you mean that man?" asked the Juror, pointing to Clerk Nell Crounse, who sits In a box bolow the bench 'Yes, I've seen him, but I don't know what he's gt all those papers for." CYCLE DODGES 1, HITS 2 First Pedestrian Escapes With Bruises; Second's Leg Broken. A motorcycle ridden by C. L. Crosby, of 31 East Eighty-fourth street, struck Bldacl Dominlco, of 2S7 Sheridan street, when he was running to catch a car at Third and Madison streets, Monday evening. Dominlco was severely bruised. In trying to avoid hitting Dominico, Crosby struck Charles W. Grenshaw, 20 years old, of 1628 Belmont street, breaking his leg. A Twenty-third street car struck the automobile of George J. Hartman, 375 Williams avenue, Monday night, dam aging the automobile, but Injuring none of the three women occupants. Forest Officer Inspects Timber. C. S. Chapman, secretary of the Ore gon Forest Fire Association, will be In the Linn County forests for the next few days. He Is there with John Marrs and K. S. Mealey, supervising wardens, Inspecting the condition of the timber In regard to danger from fire. There have been almost no bad fires In the state this year, although the weather has been unusually dry. A blaze which broke out a week ago near Timber, on the Tillamook line, is still burning, but Is under control. Among other fires along the Lower Columbia Klver which have been smoldering for two weeks or longer in slashing and former burns, though under control. Is one near Goble. A fire report was received yesterday afternoon of a new blaze In the woods of the Sllverton Logging Company. A fire that Is covering con siderable area but not doing any dam age is reported from White Salmon, Wash., as burning on Dead Horse Flat, near Mount Adams, in the Trout Lake country. It Is now a quarter of a mile wide and five miles long, but so far Is confined to dead and fallen timber, f ifteen men were sent from the munic ipal employment bureau yesterday to help fight it. PURCHASING LAW EVADED Commissioners Aver They Are Forced to Split Requisitions to Keep Within $100 Limit Hearing Launches Investigation. The general investigation Into the conduct of county affairs was begun yesterday with a meeting of the "bug Juice" committee In the offices of the Non -Partisan League in the Northwest ern Bank building. The committee Is made up of George Mason, Charles Mahaffie and Paul Seeley. County Commissioners Lightner and Holman attended, as well as a small number of Interested spectators. Chairman Mason declined to comment on the hearing at Its close, but said that a report will be made to the gen eral investigating committee at a later date. It is expected to have a meeting of the main committee this week. An attempt will be made to hold It before Friday night. The evidence brought out that Com missioners Lightner and Holman are continually forced to evade the state law In buying county supplies because of the restriction to amounts of $100 in the purchase of all articles for which competitive bids are not asked. "Requisition Constantly Split." Commissioner Lightner said they constantly split requisitions so as to keep amounts less than (100 in making non-competitive purchases of supplies, thus keeping within the law. He urged a new law that would permit more lati tude in this respect, and Commissioner Holman agreed with him. The splitting of requisitions was held by chairman Mason to be a viola tion of the law itself. Another point of some interest was the statement of Mr. Mason that he has been offered "bug Juice" of the identical brand bought by the county for II.. a gallon. lie price invaria bly paid by the Commissioners was $2, and they were given to understand no price concessions ever were made. Coat of "Bug Juice" 3180. It was established that during the last five years the county has bought "bug Juice" to the amount of 13180, of which ,.oil remains unpaid. This large c mount was required, said Com missioner Lightner, because, during most of the period covered, the old Courthouse and the old poor farm were in use. These wooden butdlings, with their old furniture, made Ideal breeding places for insects. "Here are all the requisitions, said Mr. Lightner, as he laid the documents on the table before the investigators. 'This is the point with me," declared Mr. Holman, who wanted to ask his fellow-official a question. "When these shipments were delivered, did anyone weigh and measure them? "Mr. Holman," replied Mr. Lightner, when those 10 barrels of molasses were shipped out to luultnomah Farm, since you have been office, did anyone weigh or measure them.' -'hat Is what I want to find out. ho replied. "I hope this investigation will demonstrate the need of tne ad ministrative code and show Its value." Letters were read by Mr. Lightner from many users of the particular brand of "bug ,'jlce" bought by the county. In each the price wae quoted at VI. W. H. Hollingsworth, who made requisitions for "bug juice" during the eight and one-half years he was in the Sheriff's office, testified to its value in killing insects In the Jail and he said there had been correspondence with Sheriffs all over the country on the subject.
