Several fresh scratches -were on the face of James Mcintosh, on trial for the murder of his wife, Agnes Mcin tosh, alias Agnes Meadows, when he was arrested, several days after the crime, it was testified by detectives yesterday. They were corroborated by Coroner otocum. - . With tears streaming down his face, the white-haired defendant, on the wit ness stand yesterday, denied that there was any motji:e,foiv him to murder his wirv "We never had any trouble." he said firmly, after he had quieted himself, following his breakdown during" his di rect examination by Attorney Jeffrey. He was the first witness to take the stand 'in his defense. Possibly only five or six other witnesses will be heard today before the defense rests. During the direct examination Mcin tosh did not account for his actions at the time of the crime, though he ad mitted being around the Rheinpfalz Ho tel the evening of the murder and was there when the fire departmnet ar rived to put out the fire in the room in which the body of the murdered woman was discovered. Witnesses called by the state yester day, in closing its testimony, were Ceorge Clump. Detectives Hellyer, Tackaberry and Royle, City Jailor Cam eron, Robert Doble, Miss Katherine Kalkes. Deputy District Attorney Ryan, W. W. Brunn and Coroner Slocum. CABARET DEMANDS $6300 liulkling Owner's 'Dry Activities Do $350 Damage Monthly, Charged. The prohibition activities of SeUi Riggs. owner of the building in which the Cabaret Orlll is located, are the basis of & suit filed yesterday in Coun ty Clerk Coffey's office by Fritz & Russell, owners of the grilL Large losses in their business are laid at Riggs' door. Damages to the amount ot 16300 are asked of Rlggs. The court is also asked to cancel a 10-year lease made in 1910. and stay a suit brought against Fritz & Russell by Riggs to collect $2400. alleged back rent. The suit was brought, by Attorneys Wood, Montague & Hunt. . Frits & Russell allege that Riggs. when the lease was made, agreed to do nothing indirectly to injure the liquor trade, but. In violation of that agree ment, he has joined the Prohibition party. The saloon men admit that they are losing approximately $350 a month . and have demanded that the lease be cancelled, because of Rlggs alleged , breach of agreement, but this the own er has refused to do.
