A new turn was taken In the much
muddled matter of the recovery of
Miss Amy Butler'e 57000 worth of dia
monds yesterday, when Herman Haas,
the laborer from whose basement De
tectives Hyde and Vaughn recovered
the lost Jewels, filed a motion In Jus
tice Jones' court to set aside the ac
tion under the search warrant and
leturn the diamonds to him as the
rightful custodian as against all per
sons except the lawful owner.
In accepting service of the motion,
Judgp Jones, to whom It was directed,
granted a hearing- for 4 o'clock today,
but at the saraa time announced that

his decision would be against the mo
tion.
In spite of the fact that Haas, after
finding: the diamonds where the actress
dropped them, at the back end of the
Orpheum Theater a year ago last
March, kept them concealed in his
basement until the detectives un
earthed them, he now asserts that he
was awaiting- the appearance of the
owner and Intended to return them.
He does not deny that a $100 bill,
lost with the jewels, was spent.
Technically, Haas Is gruilty of larceny
in not taking: due steps to find the
owner. It is believed that the object
of his action at this time is to in
tervene in the collection of a $1000
reward offered by Miss Butler.
Word was received yesterday from
New York that .Miss Butler, after many
doubts and delays, is forwarding the
money, which is to be paid to the un
named informant who disclosed the
hiding place to the detectives.

The date for the thicd annual Sweet
Pea Show has been set for Tuesday
and Wednesday, July 8 and 9, .and the
place where the show is to be held
will be determined at a meeting to be
held Monday by - the committee in
charge. R. R. Routledgs Is manager
of the show. " Sweet pea fanciers
throughout Oregon. California and
Washington have communicated with
him regarding terms of entry. The
committee is in communication with
Burpee, of Pennsylvania, and Morse,
of Rounert & Routzahn, of California,
and will endeavor to secure them as
judges to assist two local judges.
Prize lists, classification lists and
other Information concerning the show
are to be placed in all of the seed
stores of the city and may be had by
calling or phoning-. Members of the
Sweet Pea Society may make entry in
ine snow on their membership dues.
There will be no entry charge in the
juvenile department, whether the chil
dren are members or not.
