L LOSES POINT DlPVTK IS OVER NAMING Al . MINlSTKATOIl OF ESTATE. I'robato .liidiro Clceioii Utiles That IScIative of Detfa.-cd Is En titled to Preference. A foreicn Consul is not entitled to administer the estate of a person of his nationality tj the exclusion of a rela tive or relatives of the deceased or any one whom such rel.itlve or relatives shall desire to have appointed. Probate Judge Cleeton decided yesterday. The oiiit came up in the matter of the estate of Frank Leonetti. the assets of which consist of wages due from the Portland Lumber Company and a claim for damnpes against the same company because of his death. At the request of a distant relative ..f Leonetti. living in Portland. Jutluc Cleeton appointed Nat Costanzo admin istrator. Vr. Carlo Visettl, the Italian Consul, then came into court through Attorney le Neffe and petitioned lor the removal of Costanzo on the ground that as Italian Consul It was part of his duty to. administer the es tates ct :i luiUan subjects dying in the state. His petition was denied. TIim ...lrttrovrsv was larecly a fight between attorneys for the privilege of bringing on a contingent basis a suit for damages against the Portland Lumber Company. Albert B. Ferrara represented Costanzo and has been at- t.u-ney for tne estate since tne ue0m mux. judcre Cleeton said that, while in tne . nnteninlation of the Federal laws for- rinn Consuls are the legal representa tives of their unnaturalized country men. the law of the state govern as t, nrobate. t'nder the Oregon law relative of the deceased must be given preference as administrator o.r. if this la not practicable, shall at least have a . v aa to who shall receive the appoint ment.
