LEGAL RECOURSE FOUND Citizens Of All Shades of Politics fnite to Find Real Perpetrators of Flaming, Libelous As- sault on Colonel. Libelous circulars, issued against Colonel Roosevelt at the time of Ills visit here last week and purporting to come from Socialist headquarters, are now in the hands of the grand Jury, which is Investigating the facts and the law in the case. This action has been taken upon the angry protests of citizens of all shades of politics after the matter once had been allowed to drop. When a policeman caught a man passing the bills through the crowd at the Thompson fountain waiting to hear Roosevelt speak, the circulator was arrested and the bills were given to Captain Baty. of the detective de partment for investigation. He con sulted District Attorney Cameron and was advised that no action could be taken unless Rooseevlt could be held hera to prosecute. Leg-al Reconrse Extended. The. suDnoRltion that that was the only legal recourse has now been mod- ifled. The circular is said to be ac- tionable under the statute against printing of indecent and obscene arti- cles. This is the law under which promoters of prize fight pictures have ripn inritrtri . It also Is said that a libel action can De. carried through without any ap- pearance on the part of the offended citlzen. " These are the two possible lines of prosecution seen by District Attorney Cameron in case the grand Jury should see in to take action.,- Another dlffi culty is the likelihood that the signa tures at the bottom of the printed at- tack are not genuine and that the real perpetrators have concealed their iden tity. COLORED SUFFRAGISTS ACT Sleeting of Club but Silmly Attended. Women's Council Active. A public meeting was held last even. ing at Mount Olivet Baptist Church, 85 Seventh street, by the Colored Women's ZZ?J?"rllCJZ "rP," ?f interesting the colored voters of the city and state in the cause. Unfor tunately, the meeting had not been, suf iicienuy advertised to bring out a large attendance, but those present were entnusiastic lor the cause. Mrs. Hattle Redmond is secretary of tne club; Mrs. Kate Gray, president Mrs. Lancaster, vice-president and Mrs. Edith Gray, treasurer. Mrs. Redmond says that while there were 2500 col ored women of voting age in this city the club has only 14 members, although it has been organized two months. She attributed this largely to the influ ence of their husbands and Ignorance of the benefits' to be derived from the franchise. ABELE STANDS PAT School Inspector Must Answer Charges Made byDr. Wheeler, - Following the recent announcement of City Health orricer Wheeler mat Person ZT SH trco,y'Swtl1 result in a special meeting of the City Health Board this afternoon, at which Dr. Wheeler 'will be asked to present his charge, against Dr. Abele and the case will be given a thorough airing. The base of the action of Dr. Wheeler In demanding the resignation of Dr. Abele is said to be the failure of the tatter to make daily reports of lnspec tlons during the last term of school. A letter was sent to Dr. Abele recently requesting him to send In his resigna tlon to the Health Board by return mail. Dr. Abele says he knows of no reason why he should resign, and he refused to do so. At today's meeilng of the Board the chool medical Inspectors will be ap pointed for the school terra. Harry Young, a builder, went blithely about his work yesterday till found by Patrolman Hennessy. to whom the plea of the wife had been commu- nicated. Then Young confessed thaf he had slipped the revolver back into trunk while his wife was not look- lnff Young had threatened 100 times to kill himself, said Mrs. Young, and each time had not made good, but this time, she said, she waa sure he would carry out the threat. SPECIAL PANEL IS DRAWN Trial Term of District Court to Be Held at Medford. ' " During the session of the United States District Court yesterday it was announced 'that a trial term of the court would be held at Medford, begin ning on October 1 and a special panel of 36 jurors was ordered summoned from Jackson and Josephine Counties. United States District Attorney John McCourt was granted " an order denying a. stay of the mandate and that ft be issued on the judgment In the cases of A. H. Hedderly and' Richard Hynes. convicted of land frauds in tnis state several years, ago A. H;. Had- derly was sentenced to eight months In the County Jail, with a fine of J5000, while Richard Hynes received the same fillnir of the mandate these fines will have to be paid immediately or the full sentence will become operative. Both of the convicted men are residing in California and are under bonds of $5000 each. The court was busy during the entire day and has its work so outlined that it will be able to adjourn its session In this city tomorrow.
