TITE 3IORXTN-G OTIEGOXIA TUESDAY, MAT 28. 1913. 14 HINDU CASE PUZZLES Right to Citizenship Question of Difficulty. OFFICIALS WORK OVER IT Cate at MnrWifield, llrt on Record, JLrtcaU Vaicue Word In of Latent Con regional Act. Pflvlon Withheld. Can a Hindu become an American eltlsan? This question was brought to tha attention of fh state and Federal authorities at Marshrleld laat week. In other word. la n Hindu a fr while or of AfMrao nativity or de- rentr which la the r-adinc of taa act of Conic re a of June 2, that pro- Ttdea who can become an American citizen under the naturalization law of that date. bo far the Government ftVUU hare dodared the tsau. but It waa on a tech nical Ity that did not meet the real quraMna at laaue. and It waa practically only a postponement of the rase. More than alz months asro Taraknath Pas. a Hindu, made application to the Circuit Ork of Cooa County, at Marsh fold, to beenme an American cltiaen. This application waa referred to the Iepartmnt of Commerce and Labor for Investigation, where It waa found thnt there was no precedent for admitting a Hindu t clu-wnshtn. The matter waa thn referred to the Secretary of State. wher some of the altants of icretary Knox referred It to Attorney Cirneral Wlckeri-him. and In due course be directed I'ntted Slates Iistrtct At torney MiH'ourt to follow up the rase. Xeputy Iltrlct Attorney Johnson waa placed In charge, and waa at MarshrlrlJ whrn the application of the Hindu riimi up for hearing. Shortly after the examination waa commenced It was found that there was a dis crepancy btwen the time the man stated that he had come into the coun try In his application and that of the testimony, and under rulings of the Federal courts this is a fatal error In the application. It waa dismissed, but mlthout prejudice, and permits an other one to be tiled. From Investigation and Information received by the Government It has ra son to believe that Taraknath Ls made his application for citizenship at Marshrleld. bl levins that there It would attract little attention and never reach National Interest. Jn bis own country Taraknath Pas waa of the educated classes, and since living In the I'ntted Ftatea baa received decrees from two coMece. speak Inar the American and several Kuropean Inncuaxp perfectly. It In alleged that he waa forced to leae his own coun try on account of bring a leader In a movement to rebel ajrainst the British domination. After com ins; to this country he edited a paper at Vancouver. K, C. that advocated these sentiments, and waa forced to suspend It by the Canadian Itovernmeot. It was then transferred to New York, where It Is still Issued, and Tantknath Pas Is Its editor at Ions distance. He will continue his application until a decision Is reached whether he Is "a free white or of African nativity or descent." and there Is another question to be raided by him. and that he Is a Tirltleh subject and entitled to all of Its treaty rights, and one of which Is the riRht of Interchange of citizenship. The League of Postmasters, compris ing the non-salaried officials presiding over tha fourth-class offices, outnum ber tha salaried officials by nearly 10 to one. The league haa labored for years to have Its member put on tha classified list of Federal employes. That Is. they wish to have a tenure of office to continue during good behavior. District Attorney Cameron and the members of the county grind Jury will be appealed to today by Cornelius O. Murphy, chief of the meter division of tha water department, for a complete examination of the facta leading up to hla dismissal by the Water Board last receaiber. Roger B. Blnnott, hla at torney, said last night that he will ask. on behalf of his client, that Immediate steps be taken by tha authorities to clear up the case. "Mr. Murphy haa Instructed me to write to the District Attorney and the members of the grand jury and to ask them to make a full Investigation of thla affair, " said Mr. Slnnott last night. He feels that the administration, of which Mayor Rushlight la the head, has delayed tlitnga long enough. After his reinstatement to his position by the "Irll Service Commission last week the Mayor now saa he will require new charges of the Water Board committee against Mr. Murphy or he will ask for grand jury Investigation. "Inasmuch as It is the plain duty of the Mayor. If he thinks Mr. Murphy a guilty of grafting. aa he haa ehargeU verbally, to lay tha casa be fore tha grand Jury, he should do so without further delay. Now. my client has been under charges long enough and baa been put to a good deal of hu miliation and trouble over this affair and ha proposes to hava It over with aa soon as possible. He has Instructed me to tell the District Attorney and grand Jury that, if ha haa done any thing wrong, he wanta to be Indicted, as he feel that of all persona who should ba abova reproach a city official or puhllo servant la the one. He there fore demands an Investigation that will settle the question." A special committee of tha Water board, of which W. B. Mackay Is chairman, was to have met In session yesterday afternoon to take up the Murphy case, but J. C. Alnsworth was unable to attend and the meeting; was postponed. It will be held early, how ever, probably tomorrow. The members will determine upon what reurse tha Hoard shall pursue regarding new charges and the reinstatement of Mur phy. fnJer the original charges Murphy waa dismissed by the board for the good of the service, no definite charges being cited. The Civil Service Com mission decided this la llegal; that de finite charges must be filed. flavor Rushlight, who Instigated the charges In the first place, has announced that he will prosecute tha case to the limit. He alleges that Murphy sold city sup plies and rocketed the proceeds. WATER RIGHTS MATTER UP Staff or Stale Knglnrcr .ctive Near Soniptcr Adjudication I"ppermost. SCMrTER. Or, May 17. (Special.)
