OFFICERS JEER DEFENDANT Aged Nag, Suffering With Heaves and Fits, Guaranteed as Sound, Returned to Stable of Haw thorne Park Custodian. For selling to a farmer woman as "sound and true" a team of horses, each 20 years old, and one subject to epilep tic fits and tho other to heaves, F. A. Johnson, deputy sheriff and custodian of Hawthorne Park, was held to answer to the grand Jury, In Municipal Court yesterday. "I earned the money by hard work; please tell me the truth," said Mrs. Sedllnger to Johnson, when she made the purchase. With her young boys, Mrs. Sedllnger runs a farm near Mosler. Johnson, she says, showed his star and asked If she thought he would cheat. Mrs. Sedllnger paid 1160 for a team which, in a written guarantee was said to be sound. Oral representations were that the horses were 11 years old, a lit tle over half their true age, as estab lished by a veterinary surgeon testify ing In the case. The horses worked well enough after they left the stable, but when the family started up a moun tain road out ot Mosler, the one had a fit. and they were forced to return to the village. Having expert advice that she had been swindled, the plucky woman shipped the horses bark to Portland and demanded fulfillment of the guar antee. She says that a stranger in Johnson'a barn offered to buy the horses from her at substantially what she had paid, giving her 12.50 down, but said the witness, she saw a trap and rejected the offer. The defense contended that the flaws In the team. If any. presumably Includ ing their advanced age, had developed In the week since Johnson sold them. Also. It waa contended. Johnson was acting merely as the agent of one Baumer. KANSAS NIT TO VISIT NEARLY 100 ELK SPECIALS TO RCN TO PORTLAND. Requect Made That Residents Oien Their Homes for Entertain ment of Delegate. American Chicle Company Also In dicted for Mislabeling of Tuttl-Fruttl Product. In the United States District Court yesterday the American Chicle Com nanv. a New Jersey corporation, with a branch factory in Portland, was found guilty by a Jury ot misbranding its nrodurtlon of Beeman's pepsin gum. The extreme penalty, under the pure food law. Is a fine of 1250. and today Judge Bean, before whom the case waa tried, will pronounce sentence. The" American Chicle Company man ufactures many brands of chewing gums and another Indictment is stand ing against it for the alleged mislabel ing of Tuttl-Fruttl gum. In the case, which resulted In a ver dict of guilty yesterday, it waa charged that the company had shipped from Oregon to Washington some Beeman's pepsin chewing gum and that its label contained the statement that by chew ing the gum the pepsin In It was dis solved and was an aid to digestion. The chemists of the Government, who were responsible for the complaint being died against the company, made a test of the gum and found no active principles of pepsin in it. The testi mony presented to the Jury waa largely technical. It was shown that pepsin Is an active organism, somewhat like yeast, and that In cooking the gum this life or quality waa destroyed. The company has given notice of an appeal, but this will not stop the Gov ernment from proceeding with the case against the company In thex Tutti Frutti case, which la based on. substan tially the same charges. The result of these cases, if the de cision la upheld by the higher courts, will be that new labels will have to be used, announcing that they are a sim ple chewing gum. without any possible medicinal properties.
