11 other defendant from destroying
book and papers and other evidence
that might be useful to the Govern
ment in tha dissolution suit against
the steel corporation. -
The 12 other defendants are only a
few of those named In the Govern
ments original suit for the dissolu
tion of the steel trust. These defend
ant are proceeded aitalnit because It
is charred that In their Individual ca
pacities they are like the Steel Cor
poration, -aullty of acts in violation of
t!ie anti-trust law."

. Tlie Injunction was Issued on a peti
tion of the Iepartment of Justice which
alleges that several thousand papers
and documents, which were used In the
tjovernmenfs criminal prosecution of

destroyed.
One portion of the Governments pe
tition seems to be susceptible of the In.
terpretation that criminal Indictments
sod prosecutions of certain officers of
the stael corporation and Ita subsldl
anes are under consideration by the
department of Justice.
The Injunction, which is a temporary
one. Is to forbid the destruction of any
other books or papers which the Gov
ernment may desire In the anti-trust
suit
The destroyed papers. It Is said, were
In a trunk which was delivered on June

torney Wise to Charles' MacVeagh. cen
tral solicitor of the United States 6teel
Corporation, who gave a written agree
ment. It Is said, that he would keep the
papers In his personal charge subject te
examination by Wis or his assistants
at any time.

negotiations for these papers In connec
tion with the pending proceedings on

The papers. It Is charged In tha Gov
ernment's petition, contained matters
tending to show that J. A- FarrelL
formerly president of the United States
Steel Products (export) Company, now
president of the United States Steel Cor
poration, not only knew of said unlaw
ful pools and combinations described,
but aided and abetted In their success
ful operation.
The petition avers that certain much
wanted documents are In danger of
destruction "because there are officers
of the Steel Corporation and Its sub
sldartes who hsve not yet been In
dicted for the practices vhlch said
papers tend to show them gjllty of.
to wit:
"Of having been Involved In the
aforesaid unlawful association and also
because none of the defendant com
panies has yet been Indicted in respect
thereto."

lican state convention split Into two
factions toon after being called to or
der today, one body color to another
hall, where delegates to the National
convention were Instructed to vote for
the nomination of Theodore Roosevelt.
The regular Administration faction,
after the departure of the insurgent
delegates from the hall, organized and
elected delegates to the Chicago con
vention, whom they Instructed to vote
for the nomination of President Taft.
A state ticket was nominated by each
faction.
HILLMAN DENIED HEARING
Seattle Millionaire's Attorney to
Appeal to Supreme Court.
SAX FRANCISCO, Feb. . A hear
ing was denied today to Clarence Day
ton Hlllman. the Seattle millionaire
realty man. who was recently convicted
of using the malla to defraud, by the
United States Circuit Court of Appeals
here today. HiUman'a attorneys rave
notice of an appeal to the United States
Supreme Court, and 4S days were al
lowed them In which to prepare their
appeal. Meanwhile the defendant's
bond remains unchanred.
Hillman was convicted in the Federal
Court at Seattle. Waolu. and was sen
tenced to serve two and one-half years.
The frauds charged are alleced to have
been committed In realty transaction.

The facts concerning conditions

retary of Stat of Chihuahua, who

last week by a mob. Today their men
were dlatributed from Santa Isabell to
San Andros. Government troops have
been sent in pursuit of them.

ment now purposes to use the eame
methods employed at Juarez leaving

keenly alive to the seriousness of the
situation, but do not believe tha United
States Government Intends to adopt

denied. Newspaper comment ha

For the most part the papers appealed
to the people to support the constituted
government, whether they approved Its
personnel or not. Little anti-American
expression appears.
The government has sent to Chihua
hua 6J1 federal soldiers and 00 ru
rales. The former will be used to

Numerous reports indicating; possible
crises In the Mexican situation such as
might make necessary the calling; out

tary law. While the Oregon national
Guard Is subject to such duty. It was
decided by the officers, who are in
Dallas at their annual meeting, to indi
cate to the department the spirit of
willingness for actual service that ex
ists among the Oregon troops.
Although dispatches from Washing
ton announced that J4.000 regulars are
ready for service, this Is disputed by
officers of the Regular Army here, who
say that a larger force than JO.OuO
men cannot be mustered by the regu
lars because of the large number on
duty In Hawaii and the Philippine
Islands. It is recalled by these offi
cers that when the army of 20,000, sent
to the border last year, arrlvea unaer

centered Its attack on Swift & Co. In
the packers' trial today. John M. Chap
lln, chief' of the plant accounting de
partment of that corporation, was sub
jected to a searching examination by
District Attorney Wilkerson and re
quired to explain to the Jury many de
talis of the complex system used by
the packers.
Chaplin Identified numerous letters
changing ,4 he by-products allowances.
which were sent by other employes.
One letter signed by Chaplin and
dated November 15, 1907, gave In
structions to dlscountlnue making al
lowances for hides in figuring the test
cost of beef.
Teat Cost Shows Rises.
District Attorney Wilkerson pointed
out that from the organization- of the
National Packing Company, March 8,
1903. the test cost of beef, as figured
by Swift & Co.. steadily rose while the
allowances for by-products decreased.
A summary of the salient points
brought out by the Government In the
examination of Chaplin follows:

duced from 5 to 4 cents a pound.

AVIATOR SCARES CROWDS
New Yorker Do Not Realize That
Neffin Uses Hydro-Aeroplane.
NEW YORK. Feb. . The first suc
cessful flight of a hydro-aeroplane in
this section wss seen late today when
Frank T. Neffin ascended from the
Hudson River near Twenty-third street
and for It minutes flew up and down
the river at a height of 500 feet.
The aviator made no publio an
nouncement of his plan, and when be
alighted In the river amid floating
cakes of ice, many on shore thought
he had fallen Into tha stream. Prep
arations were making for his rescue
when it was found that he was trying
out a hydro-aeroplane.

M. Claude Casimir Perier, son of the
ex-President of France, Casimir Perier,
left for Portland 'today on a special
mission from the French government
to Investigate conditions on the Pa
ciflo Coast with regard to the opening
of the Panama Canal and the develop
ment of French commerce through
that waterway.
Immigration possibilities, fuel coats,
toll charges at the canal and harbor
facilities at the various Paciflo Coast
ports are the subjects to which he Is
devoting his attention and on which
he will make his report to the Depart
ment of Commerce and Industry of the
French government.
At the same time he has been In
structed by the Minister of Commerce
and Industry to make a special report
on the opportunities for French parti
cipation in the 1915 exposition at San
Francisco. The French agent is deeply
concerned in the tolls to -be charged
fny nneanra throueh the canal, and de
clared that if a nominal toll only were
assessed against foreign vessels a
large number of ships would compete
for business by way of the canal.
He also declared that the climate of
the Eastern States was too severe for
Immigrants from France and Italy and
that if the cost of immigration pass
age from the south of Europe to the
Pacific Coast were placed at 35 or 40,
ii would think of re
maining In an Eastern state. Thr all

present, he said.

Casimir Perier was taxen in '
the State Board of Harbor Commis
sioners today and carried by launch
to the various points of interest about
the bay, while every possible facility
was given for collecting the informa
tion for making up his report. He was
accompanied by the various officials
of the French Consulate in San Fran
cisco and the whole party was enter
tained later by the California Develop
ment Board at an elaborate luncheon.
BIG OIL DIVIDEND DUE

confirmation of reports that various
of the former subsidiaries of the dis
solved Standard Oil Company of New
Jersey are to increase their capital
stocks to correspond more closely witn
their assets. It was announced today
that stockholders of the Vacuum Oil
Company would be asked to approve an
increase of the capital stock of the
company from 12,500.000 to 110.000,000
on February 29, and that a week later
stockholders of the Standard Oil Com
pany of Indiana would be asked to In
crease their stock from ,1,000.000 to
$30,000,000.
Reports in Wall street were that the
distribution of a dividend was Involved
in each case, either as stock dividend
to the amount of the respective In
creases, or a cash dividend to tfcesame
.mmmt which would enable the stock
holders to subscribe to the stock at
par. These reports were not confirmed
Shortly after the dissolution of the
Standard Oil Company of New Jersey,
shares in the Indiana company sold as
low as 11400, and yesterday the shares

WASHINGTON. Feb. 6. The Senate
today passed a bill reducing from Ave

allied. The bill also extends to mem
bers of the revenue cutter service the
riirht of naturalization without con
tinuous residence.
It was so amended as to make sure
of the exclusion of Chinese who may
enter the Navy.
