At Portland the river was S feet at 7 ovlock In the mornlnir. a gain of l. feet In 24 hours, and a second reading made at 4:1. In the, afternoon showed It to have, climbed to . feet. In the, last read ing there, may have been some Influ ence from the tide. It waa reported, as the effect Is noticed until the stream attains a stage of 10 feet, but It is ris ing rapidly and should warmer weather follow today and thawing set In gen erally, a decided Increase will be re corded. Steamers arriving from the Lower Columbia report Ice running thick and some large floes, but below the Wil lamette there was no freezing; of the surface of the stream. The steamer (Georgia Burton left for La Camas early In the day, taking tha steamer lone's run. and the latter followed In her path, as she was not sheathed, but no late reports were received as to how they tared. The O.-W. R. A X. received word that Its service on Coeur d'Alene Lake had been stopped because of Ice. For sev eral daya a channel was kept open there by running the steamer at night, but colder weather made that Impos sible. Rlvermen say that had the Willam ette not risen during the pat two days the Lower Columbia would have frozen, as the only thing that prevents a freeze there Is the fact the current of the Willamette runs diagonally across the Columbia. United States Judge Wolverton In the Feelers I Court yesterday awarded to the Willamette Iron A Steel Works Judgment for I1S7..34 against the Steamship Roanoke In payment of re pairs. Last August, the steamer sus tained damage to Its rudder and ap plied to the libelant for repairs, with the verbal agreement that the work should be done for what It was reason ably worth. Finally the company rendered a bill for $4443 71. to which the owners of the steamer protested. The case was taken Into the Federal Court for adjustment. In pruning the claim. Judge Wolverton sustained in part the contention of the owners of the steamer that the work of repairing their craft was "negligent ly and unsklllf ully" performed. Marine Note. But a few of the 500 pigeons saved from freezing on Alnsworth dock Sat urday died as a result of the expos ure and the others were released yes terday. During the week the tug Gollah. of the Puget Sound Tugboat Company's fleet on the bar. is to be absent at Se attle, where her annual Inspection will take place January 1 1. She will be docked to have her hull cleaned and painted. Inspector Beck, of the 17th Light house District, who returned from Coos Bay Sunday, on the steamer Alliance, says that while there wax a strong blow on when the vessel left Coos Bay, con ditions grew better aa she steamed up the coast and the Columbia bar waa almost smooth. Cables received yesterday from shroud contained advices that Hind, Kolph St Company had chartered the French ship Herengere to carry wheat from Portland with the 112-13 fle-e-t. When the steamer Westerner, of the Olson Mahony fleet, arrived In the river yesterday afternoon, from San Francisco, she Was In command of Cap tain George Wlnkel, formerly of the steamer Washington, who has suc ceeded Captain Bernard Kelly. A proteet to Mayor Rushlight and the City Council against the telephone rates being charged by the Pacific Telephone & Telegraph Company was made yesterday by John Landlgan. He says he had a telephone installed at SOS Stanton street six years ago, and that IS months ago the company raised the rate to (t( cents a day. His com munication, dated January B. says: "This morning their agent called and wanted me to sign a new contract for 10 cents a day. I refused to sign until I heard from you. I have not com plained of the service or style of the phone. I am satisfied with the present rate of cents a day. What I want to know Is, if. under their franchise, they have a legal right to raise the rates. I have never given them the right to raise said phone rate." The franchise granted to the Pacific States Telephone c Telegraph Company, approved by ex-Mavor f:owe. February 21. lo;, provides that "during the ex istence of this franchise the grantee, or Its assigns, 'shall not charge or collect any higher rental for telephones than the maximum rntes now collected." City Attor ney Grant said he believes the City Council has the power to regulate the telephone rate. As to whether a suit to cancel the franchise for violation of Its provision would have merit, he does riot say. but says that as "the city has prescribed mnxlmunt rental rates, the telephone company has no right to adopt a regulation which will Increase the rental charge above what has been fixed as the maximum charge, by re quiring a subscriber to pay for the cost of Installation of the telephone and appliances." The company now Is charging a deposit of 95 for every tele phone Installed, the company keeping the deposit If the phone Is kept less than a year, and returning It when the phone Is discontinued If the subscriber demands it and the phone lias been kept longer than a year. Tremsfer Also Questioned. City Attorney Grant said. In his opinion, the Pacific States Telephone Telegraph Company had no right to turn over Its business to the Pacific Telephone & Telegraph Company with out the consent of the Council, and that he can find no record that this consent was ever obtained. "Can the company abolish its ten party lines, both residence and busi ness?" Is the question Mr. Grant asks, and then says: "From a thorough ex amination of the authorities I fall to find a single case wherein this question has ever been decided, or even dis cussed. "With no precede. - to guide me, but simply expressing to the committee my Individual opinion. I would say that the provision of the franchise of the com pany providing that It 'shall continue to maintain and operate its present telephone and telegraph system within the city,' and being a contract, binding upon both parties, if. In the judgment of the Council, the company can render efficient and satisfactory telephone service to the public, by a continuation of ten-party and four-party lines, It can be made to do so, but that necessi tates a determination of the facts, after an Investigation as to whether or not such a system can and will give to the public an efficient telephone serv ice." Although residents of IS or 20 dis tricts are campaigning for streetcar extensions for their accommodation. Portland Railway. Light & Power Com pany officials may refuse to accept franchises on any of the streets peti tioned for because of the terms de manded by the City Council street committee in tne irencu f", After two months of squabbling; the committee finally completed drafting- a proposed franchise covering 5 streets at a special meeting- yesterday and Vice-President Fuller, of the railway company, expressed doubt as to the willingness of the company to awept the terms. The main objection Is on the SeTenth street extension. The company asked for a franchise up Seventh street, from Hoyt street to Morrison street, while the Seventh-Street Property Owners Association demanded that no franchise be Riven on the street unless it extend south to Jefferson street. This tne company refused to accept, but the protest was not heeded by the street committee. By unanmious vote yester day it waa decided to require the com pany to accept a franchise on the street as far as Jefferson or none at alT. ravin- Cost Alao Fimglt. Another hitch is in the demand of the citv that the company pay Its share of costs for street Improvements on streets on which franchises are granted, but where no tracks are laid. The company declares this is unjust and probably will not accept Buch fran chises. The street committee voted to require the company to install Iron or steel polea exclusively within the fire limits of both the East Bide and the West Side. This is also objectionable, said Mr. Fuller. There are a few other objectionable features to the terms of the proposed jrrant which may result in the whole proposal being- rejected by the traction company, in which event the pleas of the various sections for more carllnes will avail nothing-. The franchise will be considered this week by the railway company and an nouncement of Its acceptance or rejec tion will be made at a special street committee meeting, to be held at the City Hall Saturday morning at 10 o'clock. The franchise as arranged by the street committee Is much more string ent than franchises granted to the company heretofore. It is said this Is done to bring to an end troubles which have resulted in the past through what are considered by members of the com mittee as lax provisions governing street Improvements and line exten sions. The Board of County Commis sioners yesterday granted the petition of business men and orchardlsts, which asked that a tax levy not to exceed a half mill be made to care for the ex penses of maintaining an expert here to make a study of and prevent orchard diseases. The members of the Board say that the expert work will be dono in conjunction with that of the county fruit inspector and it Is probable that one man will fill both offices.
