INTERIOR POINTS UPHELD
Jntantate Ooramrrc Commission
Asserts System Intended to De
velop Onlj Ports la Trans

WASHINGTON. Ir. to. Tli Inter
state Commerce fomm lesion declares la'
Us innsxl report, made public todar.
fiat "It Is a waste of transportation and
therefore an economic wrona to main
tain a system of tariffs wr.lch Is ex
press;? Intended to develop the Paclfle
l'ot cities and to arrest the derelop
ment of the Interior." This le In con
r.ectlon with Its discussion of the trans
continental rate cases. In wl.lch It takes
sharp !sue with the Commerce Court.
In discussing the effect of water com
petition upon ratea. the Commission
says It 'cannot tx a rale from New
Tork to ?mn Francisco below which the
rail line shall not to, for It has no au
thority to Da a minimum rate. There
Is. therefore, no way in which It can
prevent discrimination by the fixing- of
an absolute rate at San Francisco and
another absolute rate at Reno. It can
only accomplish this purpose by pre
ecrlblnc tue difference which mar
properly exist osier to the effect of
this competition and a How In a" the car
rier to make whatever rata It sees fit
to the more distant point, so Ions; as It
cbeerrea this differential.
Rum Ratea Wanted.
The report Indicates the desire of
shippers from points In the Interior of
the country to obtain the same rates to
the Pacific CoaM that are accorded by
tho railroads to their competitors on
the Atlaatto seaboard. The ratea are
riia.de the same by tho transcontinental
lines on tbs (round of market compe
tition. While tho Commission re comixes the
full effect of water competition upon
the rail ratea. It says: "We hare tho
frank admission of tho railroad man
asers that they have subsidised or
bous;ht some of the steamship Unas and
terrorised others until they can make
the boast that the effect of the sea has
been neutralised.
"Tho Commerce Court Intimates that
the mistake of the Commission la In
h&vlns; attempted to flx a relation of
rates Instead of establishing reasonable
rates: but. as ws have already pointed
out. there Is no way In whlcb tho dis
crimination found to exlet In theae tar
iffs can be prevented except by flxlna
a differential, since we have no power
to establish an absolute rata or flx a
minimum eharae below which the car
rier Is not free to "0.
Hlaher Rate Net JmstiAed.
"We feel stronrly that water compe
tition, even when tho widest reasonable
latitude Is riven to tho effect of mar
ket competition, cannot by any possi
bility Justify a cls;her rata from Omaha
to Reno than from Omaha to San Fran
cisco: from Ft. Paul to Spokane than
from 8t. Paul to Seattle.
"I'pon the other hand. It ahould bo
noted that tho opening; of the Panama,
Canal may eo add to the Intensity of
this water competition as to call for
some modification of tho oonclusloa new
reached.-
Many InvesMratlons were made that
disclosed practices not of sufficient
gravity to warrant prosecution, but of
sued doubtful propriety that the Com
mission ordered their discontinuance.
In this connection the Commission says
slrnincantly:
"It becomesMnereaslns-ly evident that
entire freedom from discrimination
can be secured only by a complete sepa
ration of the business of transporta
tion from every. form of commercial or
Industrial enterprises."
In conclusion ttie Commission recom
mends that the law be amended so as to
require telephone, telegraph and cable
companies to publish, file and post their
Interstate tariffs: to make tho Eiklna
act applicable to such companies: that
transportation companies be required to
adopt a. system of uniform classifica
tion of freight; to provide additional
safeguards In railroad transportation
for employes and the public: to relievo
tho Commission or tne jurisdiction or
the street railways of the District of
Columbia: to provide for the regulation
and control of capitalisation and suit
able provisions for the valuation of
railway property: and that a suitable
building- bo provided for tbo use of tho
Commission.
