Keport of the board showed that schools had been maintained at a point of efficiency on last year's le-vy, street assessments and other obliga tions had been paid before delinquency, at great saving of interest, and there remains ample funds to complete the rtsral year. The Supreme Court of the United States today opened the way for the Federal Government to prosecute coal land frauds in Alaska by holding that the general coal land ls.ws.of the United States, which for bid persons or associations from mak ing more than one entry, apply to the unsurveyed coal regions of Alaska. The Immediate result of this holding was the reversal of the action of the United States Circuit Court for West ern Washington in quashing as invalid the Indictments against Charles K. He considered the argument ot the defendants that the act of Congress In 1904 superseded the general laws, so far as the un surveyed lands of Alaska were con cerned. . "There occurs to us no reason for assuming that Congress Intended to abandon the policy of keeping open the right of every citizen to enter one tract and no more of the unsurveyed coal lands of Alaska, thut would not lead also to the abandonment of the policy as respects coal lands which had been surveyed." said the court. "An Intention to depart from a uniform policy so long enforced In regard to the coal land should not be Imputed to Congress unless the act of 1904 ad mits of no other construction." I'Bsorreyed Laad Not Excepted. Justice Lurton then proceeded to show that the act of 1904 did admit of another construction, namely, to ex tend the general coal land entry laws, which were then applicable only to surveyed lands, to unsurveyed lands. "The legislation, read in the light of the situation, and of the uniform policy which had so long prevailed," Justice Lurton concluded, "of prohibit ing more than one entry to one per son, makes it plain that Congress did not Intend to except the unsurveyed coal lands of Alaska from the opera tion of the restrictions which attached to the sale of the surveyed coal lands tn Alaska and elsewhere." Today's decision sustains that of United States District Judge Frank Rudkin In the Doughten case, rendered at Spokane and reverses United States District Judge Han ford, who on April 4, 1911, in Seattle, quashed the Indictment charging Charles F. Munday and Archie Shiels with con spiracy to defraud the United States of the use and possession of certain coal lands in the Bering . River district known as the Stracey group. The Stracey claims are situated near the Cunningham lands and are said to be more valuable. These lands are the richest undeveloped coal body in the world, The Stracey claims were lo cated by Algernon H. Stracey. of Van couver, B. C. a brother of Sir Edward Stracey. a millionaire baronet and Lib eral member of the British Parlia ment. All the claims are now held by Charles F. Munday, a Seattle lawyer, under an irrevocable power of attor. ney. According to land office records. Munday organized the Alaska Develop ment Company in 1897, and later went to England, where he Interested Brit ish capitalists, Including -Sir Edward Stracey. In a scheme of obtaining own ership of Alaska coal lands. At that time there were no coal land laws cov ering Alaska. In 1904 Congress passed an act ex tending the land law of 1873 to Alaska.
