gaged counsel yesterday and applied to

rested Fetterer at 8C Vincent's Hos
pital, explained that the absence of
the prosecuting attorney from Dickin
son. N. P.. at the time Fetterer waa
arrested, had led to the delay, but that
policeman la now on bis way to Ore
gon with the necessary papers. Judge
listens deferred the case until Friday
morning, announcing that If a proper
showing la not made at that time the
jrisonsr will be turned loose.
Fetterer's attorney declared that a
rrrar.d Jury had refused to Indict hla
client f ir the alleged offense, said to
have been committed more than a year
ago. and Intimated that the North
Jikota authorities are pressing the
charge at thle time for secret reasons.
