Hugo Albright, a deaerter from the United States Army, now serving a sentence of three yeara at McNeil's Isl and for a larceny, still wsnts to ei"ire two yeara and ono month mora. He haa figured that the one month beyond a five-year term will allow the statutes of limitation to run so that he cannot be arrested by .he military authorities and sentenced to tha military prison for desertion. When Albrtght was convicted of lar ceny In the Federal Court several weoks ago. he pleaded for a aentenc of five years and one month. Albright explained that be had deserted the Army and If sentenced to serve only three years, military authorities would arrest him at the expiration of the term and send him to military prleon. He said one month beyond a five-year sentence would frea him from prosecu tion under the military law. Tha court refused to grant the request. Deputy United States District Attor ney McGulre received a letter yester day from Albright, which renewed the rlea for two years and one month more at McNeil a Island. If this could not ba granted.
