The developments which culminated In the summoning of the children and their mothers before the Brand Jury today began yesterday, when Mrs. Mc Manltral and Mrs. Mcuire arrived on the same train that broucht Clarence 8. Harrow to the city. Trior to that time It had been expected that Mrs. McManiiral would be on the side of the prosecution, but the woman, by her actions, apparently repudiated the dec laration of the IMstrtct Attorney that she would be a star witness for the state. DENVER. June I. When District Attorney Willis V. Elliott concluded to day to give Frank Harold Henwood. club and society man, on trial for the murder of George E. Copeland. every onortunltr to "Justify his act" by with drawing hla objection to testimony concerning threats made by "Tony' Von I'hul. he evidently was not in spired by sympathy alone, for within few hours afterward he bad pinnea Henwood down on cross-examination compelling him to make the surprising admission that he was a married man Henwood. who had been received in a certain social circle of uenver as a single man. admitted that ha had a wife and two children, "somewhere In New Tork State." The Prosecuting At torney did not reach the question as to whether he had been divorced. A heated colloquy occurred between Prosecuting Attorney Elliott and John T. Bottom, attorney for the defense, over the use of the word "Intimacy" In Questioning Mrs. John W. prinrer, the principal witness In the case, con cerning her relations wltn iienwooa. Response Is Affirmative. Mrs. Springer had hastily responded In the affirmative when asked If she and Henwood had been Intimate, but Attorney Bottwm Inserted the question: "You mean that you were good friends r "Certainly, nothing more," was the reply. The defense took advantage of the change of front of the prosecution and throurh Mrs. Springer and Henwood himself brought out testimony of the enmity that existed between Henwood and Sylvester L. Von PriL whom Henwood shot to death after a succes sion of quarrels. It was a bullet aimed at Von I'hul that went wild and fatally wounded Copeland. Woman Tells Story. ' Mrs. 6pr1ne;er told the story of her relations with Von Thul; of several of their quarrels, in two of which he struck her blows in the face with his first; of threats to kill Henwood If he ever saw him going to the Sprlnrer apartments In the Brown Palace Ho tel: of Von Phul renting a room adja cent to these apartments, so that he could watch for Henwood's coming; and finally of her warning given Hen wood to avoid Von Phul. as ha was "desperate" and would kill him. Mrs. Springer also said that Henwood was asked to keep out of her "affair" with Von Phul: that It was her business and she must handle It alone. This referred particularly to the recovery of certain letters which she had writ ten Von Phul and which, it was said, he threatened to use against her. William W. Ross. Deputy Coroner, told this morning of finding torn pho tographs of Kenwood In Von Fhul's pockets after the latter had been shot. These photographs. It has been said, were given Mrs. Springer by Henwood. secured In the Springer apartment by Von rtiul and torn by him. SHERIFF AVERTS LYNCHING Two Little Girls Drowned. Accused Is Hurried Front Mob. GLOBE. Arls.. June 2. Back doors and dark streets aided the Sheriff be fore dawn today In following a mob that had gathered to lynch Klngsley Olds, accused of having murdered Lulu and Myrtle Goswlck. children of a rancher. Olds, who came Into Globe Saturday night with his lower Jaw shot away, was In a hospital when a mob gathered, but he was taken out of a back door and hurried to safety behind the bars of the county prison. olds, who came here from Bakers field. Cal.. cannot talk on account of his wound. But he was calm during the perilous moments while be awaited the bherlff. and wrote on a alio of paper; W. PRI.GEIU "If 1 am mobbed, an Innocent man will be lynched." The bodies of the two little girls who went bathing with Olds while on the way with him to their fathers ranch, were examined today. They had been drowned. No marks of violence were found upon them and they had not been subjected to any Indignity, the autopsy surgeon said. STUMP LAND SELLS HIGH Promoters Arrested After Pullman Folk Par SI 40 Lot for It. PULLMAN, Wash., June 24 (Spe cial.) George Bell, who swore out the warrants for the arrest of the promo ters of Jovlta Heights, near Seattle, for alleged fraudulent use of the mails, has returned to Pullman. Mr. Bell went to Seattle as the representative of 20 or more Pullman folk who had bought lots in Jovlta Heights at J140 lot. paying $10 cash and $10 a month. In the descriptive literature It was announced that houses costing from $1000 to $5000 would be built on cer tain tracts, and that these houses, with 100 tracts of one acre each, would be put up at a drawing to be held when all the lots were sold. Every 20 lot owners were permitted to elect a dele gate to represent them at the drawing, and the expenses of each delegate were to be paid by the promoters. Bell says he found the property consisted of stump land of little value. He con suited the United States Attorney, as sisted In an Investigation, and was asked to swear to the complaint. Ar rests followed. Nearly all Whitman County towns contributed to the 1398.000 which the company is alleged to have secured by the sale or these lots. TWO AERONAUTS DROWNED Balloon FYom Paris Fall Into North Sea, Occupants Perish. BREMEN. Germany. June 26. One of the four balloons which ascended at Paris Saturday fell Into the North Sea. near the Island of Julst, of the East Frisian group, yesterday. A violent storm prevailed at the time and the aerial craft was carried rapidly out to sea. Two persons were aboard her. The other three balloons made land Ings on the East Frisian coast. A rescue boat was sent out as soon as possible to the aid of the distressed bal loon, but later returned, having recov ered only an empty ballast bag marked "R. G. B.-70." CONDUCTOR HOBO'S TARGET When Pot Off Train at John Day Tramp Fires Revolver. THE DALLES. Or, June 2. (Spe cial.) Freight Conductor Cliff Alex ander was a target for tramps armed with revolvers at the John Day water tack Thursday. The brakeman had put two tramps oft the train when one of them began shooting at the conductor. . Railroad Detective E. B. Woods ar rested them at Umatilla and they were brought to The Dalles. Today they were taken to Moro for a preliminary hearing in Sherman County. Conduc tor Alexander Is a resident of this city and baa a run between here and Arling ton. FISH LAW COMBS THREE Itesort Manager at Pendleton Charged With Serving Trout. PENDLETON, Or. June 26. (Spe cial.) Because he served trout for breakfast. P. H. McFee, manager of the Wenaha Springs Summer resort, has been arrested for violation of the fish law by Deputy Game and Fish Warden E. B. Thompson, of Portland. Charles Maya and E. H. Bundy, both of Athena, were arrested by the same man for catching undersized trout. They were fined $23 each. Spain's Morocco Stand Fought. MADRID. June 26. Citi zens of Pac.flo County are proud of the new courthouse. AUTO SERVICE HELPS CITY Jacksonville Secures More Trains Since Competition. JACKSONVILLE. Or.. June 24 (Spe cial.) Jacksonville, whose growth has been so long retarded because of poor transportation facilities, has at last come Into Its own. V. C. Gorst, who formerly operated a passenger launch between Port Orchard and Seattle, has established an auto passenger service between Jacksonville and Medford, and It has met with such favor that he will add another machine. He makes a round trip every hour. Shortly after the advent of Mr. Gorst the Rogue River Valley Railway In creased its service and Improved Its ac commodations, and now runs 18 trains a day. A similar auto service between Cen tral Point and Medford, It is said, will soon be established. There la also some talk of a freight truck service between here and Medford. , POWDER EXPLOSION KILLS "Workers Thrown 150 Feet to Death When Plant Blows Tp. PEORIA. 111., June 26. An explosion at the plant of the Western Powder Company, at Edwards Station this afternoon resulted in the death of two men and the demolition of the plant. The explosion Is supposed to have been started by a spark. The bodies of the two men were blown a distance of 150 feet and terri bly mangled. Buy it now.
