Jr., on the charge that he had "sold out" to Ameri can Intereata whil In command of a section of the Insurrecto garrison at Agua Prleta, has been executed. Lopes waa being conveyed from Agua Prleta to Hermoaillo to begin the aarv tng of an eight-year sentence. Conflicting atorlea are told by tha guard which was accompanying Lopes. One la to tha effect that the former Insurrecto leader had attempted to es cape and waa shot; another that he pleaded to be xcuted .rather than b taken to prison. It Is alleged also that Lopes bad con fessed having received ItOOO for th surrender of Agua Prleta to tha fed erals. When his guards arrived at Cananea they delivered his scrape and sombrero to General LomelL "He tried to escape," th guards re ported. Lopes mother visited General Lo me II yesterday and asked: "Where Is my son?" "Her Is your son," th General Is said to have replied, as ha handed th serapa and aombrero to tha aged wo man. An Impressive Incident of the de parture was the farewell between tenor Madero and General Juan Na varro, ex-federal commander of Juarex, who surrendered the town and was taken prisoner. When Madero saw the rugged old federal commander want ing through the crowd, he ran forward and embraced him. Levis 4 staver. died at his home In Racine. Wis- yesterday, according to a telegram received by his nephew, i Harry Mitchell, who has charge of the , local plant of th firm. Alexander Karlin. counsel for Scheib. today applied to Justice Bischoff for a writ of habeas corpus, calling for th production of Schilb In th Suprem Court this afternoon. Scheib. the chauffeur, sticks to the story that he knows nothing about how bis wife's body cama to be In th tub at the flat they had formerly oc cupied and In a state of decomposition which Indicated that death had oc curred four months ago. Scheib Is held on a definite charge of murder in the first degree, whereas there waa no serious charge against him yesterday, when the court felt inclined to grant his application for freedom. Ha Is expected Sunday. Ferris Is a Los Angeles promoter: In last year'a stat csmpaign h waa a candidate' for th Lieutenant-Governorship nomination at the Republican di rect primaries. Th rebels' action followed an ad dress to the Insurrectos, who now num ber about ISO men, by Louis James, a rebel captain. ' A new flag and new constitution are being prepared. Captain James told the rebels that they should drop all connection with the Mexican Liberal party, with all other organizations in the United Slats), form a provisional government and demand recognition of Francisco Mndero and his party In Mexico proper. General Pryce went to Los Angeles to learn from the Junta what became of the man he aent up there with a considerable sum of money to buy am munition and supplies for the rebels at Tla Juana. The ammunition and sup plies failed to come. The men are out of ammunition, have no prospect of obtaining supplies, and are aald to be on the point of selling their guns and quitting Lower Cali fornia. Leslie and ex Presldent of Common Council 'William Brand. The latter Is serving a term In th 'Western Penitentiary. Th court granted the nolle pros on application of District Attorney Blake ley, who said the commonwealth's cases had been weakened by the death of two Important witnesses, Ollle Ham ilton and Charles C. Fltxslmmons. and also that sentiment In the community had veered around aa to tha graft prosecution. The court also allowed a nolle pros of the Indictments against Frank N. Hoffstot. of New York, the banker and manufacturer, and the other defendants. Charles W. Friend, a wealthy busi ness man who pleaded nolo contendere to a charge of giving ex-Councllman Charles Stewart bribe money, was fined 1600 and costs. Grants Pass Wants New Charter. - GRANTS PASS. The Boy Scout movement has again proved Its usefulness, for a party of the Loyal Company this afternoon surrounded and captured a daring criminal who had eome hours previous ly murdered George Bell, chief pt th city police force. It was early this morning that th chief was going ' homeward, when h was attracted by th command "Hands up!" It came from across the street, and, running over, h was In time to see two masked men going through a cltlxeo. Bell pulled hla gun, but was not quick enough. One of th robbers shot him through the abdomen, th wound resulting In death this after noon. The entlro police fore was put on the trail of the two men. who fled to the bush north of town. Then It was suggested that th Boy Scouts be called out, and they were ent to scour the country. They came across the lalr of the two men on a bluff, where they were surrounded, and, with loaded rifles of small caliber, ordered the men to glv themselves up. Seeing no chance of escape, the men surrendered and gave their names ae George Kelly snd W. Wilson, two local thugs, who have been before th pollc magistrates on several occasions. Triumphantly the scouts marched their prisoners Into town, after mak ing them throw down their guns and march several yards In advance of. the company. Kelly confessed to having fired th hot which killed Belt TREASURY HAS SURPLUS Gold Piles Up and Receipts in May Beat April Total. WASHINGTON. June 2. The Treas ury made a much better showing for May than It did for April, and its con dition as compared with a month ago is materially strengthened. The piling up of gold coin and bullion In the vaults continues steadily. A little more than 11.815.000,000 was there today the high-water mark for the Treas ury's gold holdings. The Government's finances begin a new month's business on the basis of a surplus. It is small less than a million dollars but a surplus Is shown In spite of nearly ,3,000.000 spent for the Panama canal. Under ordinary circumstances a surplus of nearly $5. 000,000 would be shown. May receipts from all sources ex ceeded $66,000,000 and beat April by $10,000,000. Expenditures, however, were held down to about $56,000,000. some $3,000,000 greater than last month.
