Stroble sought to show that they had plied him with Intoslcants and then prevailed upon him to steal the automobile, but all denied the charge. The assessment was not paid, and ac cordingly City Treasurer erleln sold the property at public auction on June 29. 10. to M. M. Bingham for $162.81. After three years had passed as re quired by law. and the original owner of the property had not paid the re quired fees and redeemed It, Mr. Wer leln executed a deed in behalf of the city to the purchaser, and the validity or this deed was not attacked until Mr. Jeffery filed the suit tried yester day. Judge Morrow found Taws in the original proceedings of the sale, the principal one being that the City Treas urer had failed to make a formal re turn of execution, but Instead had sim ply made a notation on the record re garding the person to whom the sale was mads. Had the court not found the section of the charter partially In valid, this would have made no dif ference, for the Intention of the sec tion of' ths charter referred to meant that ths deed Itself was evidence that ths proceedings were valid, unless It should be proved that there had been fraud In the making of the assessment; that the payment of the assessment haa been satisfied before the sale, or the land had been redeemed In the required time; or that the assessment had not been legally roads against ths owners of the property. Thirty years of married life, filled with continued matrimonial difficul ties, csused Mrs. Ella Stewart to bring suit yesterday in the Circuit Court against Jerome Stewart on the grounds of cruelty. Mrs. Stewart alleges that her husband owns a saloon at Thurman and Twenty-third streets, which Is val ued at $25,000. and she asks the court to give her an order to' restrain him from disposing of the property and leaving the country to prevent her from obtaining her share. The Stewarta were married at Dallas. Or, October 3, 1881. and have two grown children. The husband, the wife alleges, was never thoughtful of her, and would remain away from her for days and nights at a time. She accuses hlra of keeping company with other women. Sines March 4. 1909, ths com plaint says, the husband has lived away from ths plaintiff and has re fused to provide for her. Shs has been supported by her grown children. Cruelty Is the charge made by Mrs, Anna Hayner against Raymond Hayner. They were married at Vancouver, Wash, July 11. 1906.
