FOES 01 NEW TACT Non-Resident Taxpayers Now Sought to Block Bridge. FEDERAL ACTION IN MIND Morlta Thomsen and W. TJ. HToflns, Chosen by Swlgert and Klernan as Nominal Plaintiffs, Unlike ly to Agree to Plan. Unsuccessful n their many efforts to have the construction of the Broadway bridge prevented by court decree. C. F. Swigert, president Of the Port of Port land Commlaslon, and Frank Klernan have started out on a new tack, which conalata of attempts to have non-residents of the state apply to the Federal Court for an order restraining the build ing of the bridge. Morlts Thomsen and W. D. Hoflus, of Seattle, owners of the Seattle Dock Company, In which title to tha Chamber of Commerce bulld'ng Is vested, had been eeleoted by Messrs, Swigert and Klernan to apply for the order. According to a statement made by Mr. Hoflua at the Imperial Hotel last night, there is small chance for their doing so. Mr. Hofius said that neither he nor his partner wished to become embroiled In the Broadway bridge fight. Mr. Hoflua. on hie way from Loa Ange les to Seattle, stopped In Portland yes terday. On going to his office In the afternoon be found Mr. Swigert waiting for him. Mr. Swigert. he aald, did not do much talking, because John B. Teon and others were In the office, but from what was said Mr. Hofius gleaned that efforts were being made to have Mr. Thomsen and himself agree, as owners of the Chamber of Commerce building, to apply for a restraining order In the Federal Court, a right which they would have by reaaon of being non-resident taxpayers of the state. "From what Mr. Swigert said I Judged that he had talked the subject over.w'th Mr. Thomsen when Mr. Thomsen stopped off here on bis way from California to Seattle a few weeks ago," said Mr. Ho fius. "Mr. Swigert told me In a genera way what was wanted and asked me to talk It over with Mr. Thomsen. He waa un der the Impression at first that I had seen Mr. Thomsen since he had. "John Yeon told me that Frank Klei ns bad been In tha office before my ar rival, but had left. From what waa aald I am under the impreaalon that ba and Swigert earns together. I do not know Mr. Duntway, Mr. Kiernan'a attor ney. He was not in my office today." Mar'ts Thomsen will arrive In Portland from Seattle this afternoon. Although Mr Hofius haa not seen him since they met iu Loa Angeles a few weeks ago, which was before the time the proposal was made to Mr. Thomson, he said he felt certain that rls partner would not be disposed to conform with the request of Swigert and Klernan.
