RIVER PIRATE GUILTY
TAIS" testimony convicts
FERRAX OF THEFTS.
Jury Recommends Prisoner to
lienlency of Court looting of
Launch Was Crime.
George Ferran, one of the river pirates
who with George Burke was accused of
numerous thefts along the Willamette
River, was convicted at 6:30 o'clock last
night of having stolen a revolver, guns,
toe It. holster, ammunition, pair of boots
and three brass launch lanterns from the
tioathouse of W. E. Roberts.
rthe Jury retired at B o'clock and was
out one and one-half hours. Ferran was
recommended to the leniency' of the
'Court. Judge Cleland, In whose- depart
ment of the Circuit Court the case was
years and six months, was brought baok
to Portland and testified yesterday against
his "pal." He declared Ferran took the
articles, -while Kerran, on the witness
stand in his own behalf in the afternoon,
insisted Burke stole them. The houseboat
wan near Linnton.
Roberts, Contable Wagner and J. F.
McCullougti were the chief witnesses for
the state. Wagner told how the thieves
were captured. After locating them,
Wagner sent a farmer to tell them he
had a sick horse that had fallen and that
he wanted them to help get it up. They
fell into the trap and were pounced upon
by the Constable and his deputies. Burke
reached for a revolver when ordered to
throw up his hands, but a few shots fired
in the air induced him to submit to ar
rest. Ferran started to run toward their
boat, in which was a small arsenal, but
McCullough. who' helped in the arrest,
headed him off. The two were brought
to Portland and placed in jail.
Burke was tried on a charge of steal
ing motors and relays from thH O. R. &
N. Co., his conviction and sentence re
sulting. The boatbouse charge against
him was dismissed yesterday morning as
tried, will pass sentence at 9:30 A. M.
Tuesday.
Burke, who was convicted recently and
sentenced to the penitentiary for five
it was necessary to dismiss It before he
could testify for the state. ...
