There having been Hied In and present
ed to this court a petition wherein and
wherefrom it is made competently to ap
pear that Portland Development Company,
a corporation duly organized and existing
. under and by virtue of the laws of the
State of Oregon, with its principal office
and place of business at Portland In said
state, has suffered foreclosure of all of its
properties under certain purchase money
mortgages therefore executed and de
livered by It, and that moneys have been
advanced from the receivership herein and
from other sources for the protection of
the properties more adequately to secure
the repayment of the sums of money due
. the Title Guarantee &. Trust Company
theretofore incurred by Portland Develop
ment Company to it, and that for further
assurance in and about the conveyance of
said land to the purchaser at such fore
closure sales, under the decrees of fore
closure conveyances should be had and
given by Portland Development Company
and by the receiver herein for the further
assurance of title thereto, and it being
further made to appear in and by said pe
tition among other things that deeds of
conveyance should be executed evidencing
paper title acceptable to purchasers to
whom sale of said property may be made,
and it appearing that the usufruct of the
properties is destroyed and the same prac
tically valueless without a ready means of
sale of the same, and the court being
fully advised lit the premises, it is now
here
Considered, ordered, adjudged and de
creed on this 8th day of June. 1910, that
- unless parties and persons objecting there
to shall intervene and show cause herein
on or before the 2oth day of June, 1910,
in this our court at the Federal Court
house in the City of Portland, before us
at the corning In of court on said day, R.
S. Howard, Jr., receiver, and those other
persons, officers of said Portland Develop
ment Company, shall be and under this
order, unless objected to, may be author
ized, empowered and directed to make,
execute and deliver. In the name of Port
land Development Company, all and every
and singular quitclaim deeds, further as
surances of title and relinquishments as
may be reasonably required for the fur
ther assurance of title acceptable to pur
chasers of the properties Involved In said
foreclosure suits more particularly de
scribed In said petition, as well as in and
to the property covered by the mortgages
therein referred -to, to the end that full
confirmatory title may and shall be had by
said purchasers in and to said properties.
All persons having or pretending to have
any right, claim or interest adverse or
against the conveyance of said properties
are hereby required and cited to be and
appear before us at our said court in the
Federal building at the coming In of court
on the 20th day of June, 1910. or as soon
thereafter as they can conveniently be
heard on said day, there cause to show,
if any they have, why said conveyances
should not be made, and in default there
of R. S. Howard, Jr., receiver, and by vir
tue of his relationship as such, president
of Portland Development Company, be and
he is hereby authorised and empowered to
make, execute and deliver deeds of con
veyance and quitclaim and further assur
ances of title as may be required to the
purchasers at foreclosure sale, for the
causes and reasons set forth herein;
