Sngton, April 2S. The bill authorizing the
Bale of the Walla Walla military reser
vation to Whitman College at $150 per

tarian fight", and Indications- now point
to itB probable defeat.
Representative Poindexter today In
formed friends of the bill he could no
longer support it, that it was being
fought because of the Catholics of his
district and he did not wish to Incur
their opposition. ICe pointed out that
most of the telegrams sent to the mili
tary committee protesting against the
TdHI came from prominent Catholics.
Another interesting development came
today. A telegram was received by tne
chairman of the military committee two
days- ego, signed "First National Bank of
Walla Walla," and saying that John An
keny, H. W. Martin and Robert Johnson
, had deposited in that bank $92,500 to guar
antee they would buy the military reser
vation, at $300 per acre. Today a teler
gram was received from tho cashier of
the bank saying no such deposit had been
made with his bank and that the original
telegram was not sent with the knowledge
or consent of the bank authorities. Along
With, this telegram came other messages
Baying that no offers to buy the reserva
tion at prices above $150 an acre were
bona fide, but that the senders were
merely undertaking to prevent the pass
age of the bill for sectarian reasons, or
In hope that tho Government would again
restore troops to Fort Walla Walla if
the reservation was not sold. This com
plication will have a deterrent effect upon
the committee, which will again consider
the .bill Tuesday next.

PORTLAND, April 28. (To the Edi
tor.) In 'The Oregonian of today I
note an editorial on the subject, "Too
Much Power," criticising section nine
of the proposed railroad rate bill now
before Congress.
By the provisions of this section the
Interstate Commerce Commission is
empowered to suspend the imposition
Df any new classification or interstate
rate before becoming effective. This
wise and necessary provision to Insure
the shipper a right to be heard before
his rates or classifications are changed,
has not only the sanction of the great
shipping and manufacturing Interests
of the country, but is in the interest of
sound "National policy in the supervi
sion of railroads. The terrible effects
ivhich followed the attempted change
In the Eastern lumber rate are well
remembered by every citizen of Oregon
and Washington. The destruction a'nd
cessation of business Incident to rate
juggling closed down hundreds of
mills and rendered for a time valueless
millions of dollars' worth of property.
Through the splendid efforts of The
, Dregonian, an amendment to the inter
state act was introduced by Senator
Pulton, to clothe' the Commission with
the power to suspend a rate prior to
the determination of its reasonableness.
The only recourse open to a shipper to
prevent the Imposition of a new rate Is
to secure, if possible, an injunction from
a- United States Circuit Court. This is
doubtful alternative and a remedy
that Is not always available. It in
volves furnishing a heavy Indemnifying
bond, and a single shipper in most
cases could not stand the expense of
the litigation.
The subject of enlarging the power
Df the Interstate Commerce Commis
sion was unqualifiedly advocated and
supported by ex-President Roosevelt
and President Taft in special messages
and the National Republican conven
tion at Chicago indorsed the idea. The
Interstate Commerce Commission and
practically every commercial body in
the United States has' petitioned Con
gress to confer this necessary power
Dn the Commission, in order to safe
guard the commercial interests of the
country. A court without the right to
rxercise Injunctive power is practically
Shorn of its most important function
ind is impotent to prevent impending
11am age.
The only criticism that the writer
would offer to the proposed amendment
Is that instead of making it 90 days
before a rate which is protested could
become effective, it should be left to the
discretion of the Commission, who,
through reason of excessive business.

In the short time designated.
Any rate which has been in effect for
a long.period can be fairly regarded as
& remunerative rate, and the time nec
essary, to hear and determine the rea
sons for the advance should not work
. a great hardship on the railroad, while
the damage to the shipper from' the
change might prove irreparable.
Probably to The Oregonian more
than to any other agency, the splendid
educational campaign that has been
waged In the advocacy of'this most
meritorious measure throughout the
United States, Is due. In a former se
ries of articles which went to the mar
row of the proposition. The Oregonian
took the splendid stand that "a rail
road tariff is in effect a contract be
tween the railroad and the shipper, and
Its terms should not be changed with
out both parties being heard." This
is the last word on the question. The
English language Is Incapable of pre
senting ttie subject more clearly and
succinctly.
The reference made to "the absurdity
as well as the danger of placing such
unlimited power in the hands of a few
men can be understood when it Is noted
that the making of new schedules and
classifications, even by the most expert
railroad men, is In operation at all times,
attended by the chance that they wili
not stand the fire of a practical test and
will need changes to meet requirements
and conditions that cannot be thoroughly
understood in advance."
It is with a view of meeting Just
the proposition as stated that the Cum
mings amendment is offered. A rate
in as much a part of the business as
the business itself. Rates absolutely
determine the extent of distribution.
Experience has shown in rate litigation

did not allow the traffic to move they
could be restored, and were largely

against a repetition of the terrible dis
asters which flow from rate disturb
ances, Cummings' amendment is of
fered. Canada and Mexico have in
corporated in their railroad regula
tion the provision which Insures tariffs
being supervised before becoming ef
fective; and surely the United States
cannot afford .to do less.

HIGHER WATER PREDICTED
Weather Man Issues Warning to
Boatmen on Willamette.
District Forecast Official E. A. Beals
predicts a rapid rise in the Willamette
River during the next three or four days.
The water will reach a stage of 15.5 feet
by this afternoon and by Sunday will
be 1.2 feet higher. The rise at Portland
will be all 'backwater from the Colum
bia, as is usual with the Spring rise. The
Snake River is rising slowly, at Lewis
ton, but the Upper Columbia is coming
steadily. The rise at The Dalles yes
terday was 1.6 feet."
Freight on several of the docks is
liable to damage unless removed at once.
At the Columbia dock. No. 1, and Albers
dock. No. 3, there is considerable con
gestion. The German steamship Augustus
Is discharging at these wharves . and
the agents' are anxious that consignees
get their merchandise away as rapidly
as possible.
Fair and warmer weather is predicted
for today with westerly winds. The
maximum temperature yesterday was 60
degrees and the minimum 42 degrees.
No rain fell in the vicinity of Portland.

TABERNACLE TO BE READY
Hawthorne Park Revival Services to
' Begin Sunday.
The tabernacle which is being built
in Hawthorne Park for revival union
meetings in May will be completed bjf
Saturday evening, ready for the open
ing services Sunday afternoon at 2
o'clock. Rev. Lewis F. - Smith, chair
man of the general coramitee, is su
perintending the work. Men were wir
ing the building for the electric light
yesterday and water-proof roofing was
placed yesterday. More than 100 elec
tric jets will Illuminate the auditorium
and colored lights will he placed at the
entrances. Rev. H. C. Hart and Rev.
Arthur Magaan, the evangelists, passed
through Portland yesterday on their
way to Seattle for a short 'stay, but will
return today and be present at the
general reception to be given in their
honor tonight.
Arrangements have been made to
seat 300 singers just back of the speak
ers. Lists of singers are being sent
in from the 14 churches which have
Joined in the union meetings. At the
reception to the evangelists tonight the
union choir will have its first rehearsal
in charge of Rev. Mr. Magaan. Forty
ushers have been appointed.
CLASS TO BE GRADUATED
Medical Department to Hold Exer
cises in Portland Monday.
The exercises, of the graduating class
of the medical "department of the Uni
versity of Oregon will be held Monday
night In the assembly hall of the Lin
coln "High School. President Campbell,
of the University of Oregon, will confer

made by Mr. Pipes and Mr. Huston
favoring a "non-partisan" Judiciary,
the only legitimate objection to them
being the fact, not specifically denied
by anybody yet. that we have never
had in Oregon any other kind of ju
diciary. That we have had was not
asserted, even by implication, by the
distinguished speakers. So far as has
ever appeared. not a single opinion has
been delivered by- any of our courts,
high or low, which has been influenced
bv partisan beliefs or motives.

TWO ARRESTS IN FISH WAR

Quantity of Salmon Alleged to Have
Been Brogulit Down River Sat
urday Bases Complaint.
As a result of further activities on
the part of Master Fish Warden Mc
Allister to enforce the closing of the
Willamette and Clackamas Rivers, in
accordance with the orders of the
Fish Commissioners of the state,- two
arrests were made yesterday after
noon by Constable Wagner, on war
rants issued from the Justice Court.
John Meehan, president of the Port
land Fish Company, and John Kelly,
one of the company's employes, were
arrested for unlawfully having in
possession and transporting salmon
fish, caught and taken during the
closed season. Kelly, as the agent of
the company, is said to have broughf a
large quantity from up the river on
Saturday. He was taken into custody
for actually committing the act, and
President Meehan for being the of
ficial head of the corporation. Each
gave $250 cash bail and was released.
They will have a hearing before Jus
tice Olson today.

Court, in which the power of the Fish

Attorney Fitzgerald, as showing the
contention of the fishing interests that
because proper notice has not been
served upon the fishermen they were
not liable to the law, and also that the
amendment of the statute did not ren
der void the powers conferred upon
the commissioners.
The part of the decision referring to
this issue reads as follows:
In the case before us the statute Is valid
and the order of the Board was made in
conformity -with the power conferred; and.
therefore, was not an Infringement of a civil
rlfsht of plaintiffs. They have no rlfrht to
fish for salmon during; the period during
which nshing is forbidden by the order and
notide. and whether they are criminally
liable for a violation of th order, by rea
son of the insufficiency of the service of
the notice, equity will not entertain Jurisdic
tion to determine, the remedy being com
plete at law. This same principle is rec
ognized In tax sale cases. It is only when
the tax Is void for Jurisdictional defects
that equity will Interfere.
Mr. McAllister yesterday announced
his belief that all unlawful fishing op
erations have ceased. He will now turn
his attention to properly regulating
the lawful operations of . the salmon
fishers, which will commence next
Monday. He will leave today by
launch for a trip down. the river to
Astoria, inspecting conditions and in
structing his deputies.

are catching as many , salmon as ever.
After the experience of Tuesday, when
tons of fine salmon spoiled because
they could not be sent across
the Multnomah County line, the fisher
men awoke to the fact that their fish-,
ing was at an end until May 1, unless
they were able to dispose of their
salmon.
The fishermen accordingly arranged
to sell their catch here, and during
the last two days thousands of pounds
of salmon have been salted down.
Practically all of the catch is being
handled this way.
CURB CHANGE QUESTIONED
Authority of City to Charge Cost to
Abutting Owners Doubted.
City Engineer Morris has raised an
important question in regard to the
removal of curbs by order of tho City
Council, the question of law being
whether the city has authority to
change the curb lines and charge the
cost of the abutting property-owners.
City Attorney Kavanaugh has been in
structed to investigate.
A large number of curbs have been
changed by order of the Council from
time to time, but Mr. Morris has de
clined to approve -any more of these
plans until he has a favorable report
of the City Attorney. If the report is
unfavorable, no more curb lines will
be changed, unless the consent of all
the property-owners concerned can be
secured. Mr. Morris' belief is that a
