beginning: of what promises to be a long
contest. In a decision rendered by Mr.
Prouty the Interstate Commerce Commis
sion today ordered the Harrlman lines
and the Northern Pacific to Join In the
sale of through ticket and the through
checking of baggage between Eastern and
Pacific Coast points Tim. Portland. Chair
man Knapp and EL E. Clark dissent from
the decision.
The Commission sustains the complaint
against the Northern Pacific for refusing
to sell through tickets via Portland to
points on the Union Pacific and. Chicago
: Northwestern, including Omaha, Kan
sas City and Chicago, and sustains also
the complaint against the Chicago A
Northwestern, Vnlon Pacific. Oregon
Short Line and Oregon Navigation Com
pany for refusing to sell through tickets
via Portland to points In Washington.
Mnst Sell Through Ticket?.
By the terms of the decision, which
Is highly Important to the traveling pub
lic and to the Western and Northwestern
railroads, the Northern Pacific, the Un
ion Pacific lines and the Chicago & North
western Railway are ordered to Join In
the sale of through passenger tickets be
tween Seattle and other points in the
Pacific Northwest and Eastern destina
tions, via Portland. Or., and to accord
through facilities, like the checking of
baggage, over this route.
The Commission found in the present
ca.e that a substantial part of the entire
body of travelers moving between thma
points in the Northwest and Eastern des
tinations reasonably desire to travel via
Portland, and that therefore the Com
mission has Jurisdiction to open that
gateway.
It is also held that public interest re
quires that this gateway shall be opened:
but that the terms under which that serv
ice is rendered should be Just ss between
the carriers themselves. The Commission
was also of the opinion that the through
rates via Portland should be the same as
those in effect via the Northern Pacific
and its present connections, but no opin
ion is expressed touching a division of
these rates.
Joint Rates Both Ways.
The decision orders, first. that the
Middle West lines complained of and
the Northern Pacific shall establkih be
fore July 1. m, and maintain in force
thereafter for not less than two years,
through routes and Joint rates between
Chicago. Council Bluffs and Colorado
common points via Portland and points In
Washington between Portland and Seattle,
including the latter, the Joint rates to be
the same as the joint rates contemporane
ously In effect between said points via
the Northern Pacific and its connections.

X. P. to Seek Injunction.
It is understood authoritatively that it
Is the Intention of the Northern Pacific.
In connection perhaps with other roads,
to seek an Injunction restraining the
Commission from putting its order into
effect. Should such an injunction be
granted, it would prevent the enforcement
of the order during the period of the
Alaska-Yukon-Paclftc Exposition at Se
attle, as It is estimated that it would re
quire many months for the courts finally
to determine the case on its merits.

Northern Pacific Will 'contest Gate
way Decision, to Finish.
Judging by the provisions of the law
regulating the powers of the Interstate
Commerce Commission. It appears very
likely that the Commission will be com
pelled to withdraw Its decision within a
few months. President Howard Elliott,
of the Northern Pacific, recently an
nounced his Intention to contest any de
cision in the Supreme Court and will
probably start the ball rolling immediate
ly by asking the courts to grant an in
junction restraining the Commission from
enforcing the decision, pending a suit to
determine the powers of the Commission.
According to the law determining the
powers of the Interstate Commerce Com
mission, the Commission has a right to
enforce through routes and rates, where
there is no satisfactory through route.
The present case Is not believed to fall
within that category. The Commission
has not necessarily to be satisfied that
the route to Seattle via Portland is more
satisfactory to the travelers or even
shorter than the direct northern route.
The position of the Northern Pacific
bas been that It is not fair to order the
road to sail tickets from points east of
Cheyenne and Denver that will give the
O.-R. & N. the long haul to Portland and
the Northern Pacific the short haul from
Portland to Seattle, when Its own road
can be used for the whole haul or for the
longer part of it.
In territory west of Cheyenne and Den
ver the Northern Pacific conceded that the
Union Pacific has the most suitable haul
and permits passengers and baggage to
be routed over the line to Seattle via
Portland.
The idea of the Commission is evidently
to open all closed gateways. The effect
of the opening of the Portland gateway
Is held to be that the O. R. A N. would
permanently postpone its line to Puget
Sound on the ground that no railroad
wishes to build Its own line If It can use
the tracks of another competing road. If
the decision of the Commission were to
stand. railroad building all over the
Northwest would be crippled, say students
of the railway game.
