Feb. 8 Within a few days It Is cxpeotetl that Senator Perkins, tiie senior Senator from California, will make a reply from the floor of the Sen ate to the attacks made upon him by President Roosevelt apropos of the recent anti-Japanese legislation In his state. Senator Perkins consulted with several Senators on the subject today. It is urged, that while there' may be a differ ence of opinion between the Senator and his colleagues as to the rights of a state to take certain action, regardless of trea ties entered into by the Federal Govern ment, he will have strong support on ac count of the disapproval among the Sena tors of an attack upon one of their num ber by the Executive at this time. Senator Perkins claims that the criti cism of Ms attitude on the naval pro gramme Is unwarranted. Defends Record on XaTy. "In 1?3." he explains. "I became1 a member f the Senate naval affairs com mittee. At that time we did not have a single battleship in commission and very few first-class cruisers, torpedo-boats and other modern vessels of war. "The appropriation of was only for the support and building of tlie Navy and everything else. The naval bill now pending in the Senate carries more than $12S.t.0f. "In ISO we had but 15.000 sailors and marines. Today we have about 45,000 sailors and marines. "I have voted for every increase in the naval appropriation that has come b?fore the committee with th exception of the last proposal to build four battle ships in one year, which I did not think expedfent, believing it the part of wisdom f.nd wise business policy to profit by our own experience and the mistakes in naval construction of other countries. "As a verification of what I say, I would refer to the Congressional Record, which records every vote for and against ar.y pending measure." 'ow Position Adds Interest. The fact that In the prospective reor ganization of the Senate committees. Senator Perkins of California will suc ceed Senator Hale of Maine as chairman of the committee on naval affairs, has lMd the effect of adding to the Interest m the President's reference to the California Senator as one who has hampered the growth of the Navy. The subject was discussed today in both houses of Con gress and received special attention from members of the California delegation. Representative Knowland expressed the opinion that Mr. Perkins had not de served the President's censure. He said: "I have been Inclined to uphold the President in his efforts to bring about an amicable settlement of the Japanese ques tion, but I certainly deplore his attach upon Senator Perkins, and I believe this Is virtually the sentiment of. the Cali fornia delegation. "As ranking member of the Senate committee on naval affairs, no member In Congress has been stronger or a more consistent friend of the Navy than the senior Senator from California. Instead of hampering the development of the Navy, he has rendered conspicuous serv ice in bringing it up to its present high standard of efficiency. Senator Perkins, together with the other members of the California delegation has been urging for the past two years the retention of a formidable fleet in Pacific waters. If a serious situation has existed in our re lations with Japan it would appear to have been criminal to take the entire fleet from Pacific waters. The President should be backed in his efforts to settle the Japanese matter by diplomacy, but we must avoid any expressions of undue fear." FULTON BILL DEAD SEXATE GROWS IXDIGXAXT Gives Sympathetic Ear to Perkins Reply to Roosevelt. WASHINGTON. Feb. S. Under the guise of considering the nomination of W. D. Crura, negro collector of customs, at Charleston, S. C, the Senate in ex ecutive session discussed the Japanese question. Incidentally the discussion turned upon the reference to Perkins by President Roosevelt In a telegram to Governor Gillett, of California, in which he said that the senior Califor nia Senator had hampered the ad ministration In its efforts to build up the Navy, yet now "advises a policy of wanton Insult." Tillman, colleague of Perkiis on the naval affairs committee, referred to the statement and Indignation was shown by other Senators because of the attack upon Mr. Perkins. Both California Senators took part In the discussion. Perkins declared he had not been asked by the President to participate In the conferences concerning the Japa nese situation in California. He said he could not understand why the Pres ident should Intimate, that he had tried to stir up the sentiment In California in opposition to the efforts of the President- He stated what-his posi tion had been on the subject of a big Navy, declaring that he had always been in favor of a steady growth of the Navy, even though he was against the President's four battleship pro gramme last session. Flint declared he had not partici pated in the conference at the White House until he was asked to serve as the intermediary between the adminis tration 'and the California Legislature. The Inhabitants of the neighboring valleys are not fright ened, despite the frequent earthquakes and volcanic disturbances. Adverse Committee Action Doom of Measure. ELKINS PRESENTS REPORT Senate Committee Declares Pro posed Change "Would Put Premium on Protests and Rob Roads. WASHINGTON. Feb. 8. Senator El kins, chairman of the Senate committee on interstate commerce, presented a report to the Senate today in support rff the committee's adverse action on the Fulton bill, which would authorize a suspension by the Interstate Com merce Commmission of a proposed change of rates by a railroad, upon protest from a shipper. The "report says: "The conferring upon the commission of the power to suspend a rate ad vanced either upon the filing of a pro test by a shipper or in the discretion of the commission, taken in connection with the provisions of the statutes which gives to the commission the power to fix a rate and designate the time, not longer than two years, that it should remain in force, would ul timately turn over to the administra tive body the function of initiating the rates of the entire country. Premium on Protest, "It would offer a premium to every shipper to enter a protest against the advance of rates, whether they were reasonable or unreasonable, even if dis cretion were vested in the commission. If a protest prepared by skilled attor neys, presents a prima facie case of unreasonable advance of the rate and offers no opportunity for an Investi gation before It must be acted upon by an official body on which was im posed the responsibility to act. this body would be constralnedtp suspend the rate until a final determination of the complaint. As to Present Law. "If the decision is that the rate Is unreasonable, a Judgment may be ren dered in favor of the protest for the difference between what the commis sion determines is a reasonable rate and the rate fixed by the carrier, with 6 per cent interest from the date of the overcharge. "If, on the other hand, this amend ment should receive the "approval of Congress and the rate filed by the car rier should be protested and then sus pended by the commission (in the multiplicity of duties imposed upon that tribunal), considerable time would elapse before a final determination of the question could be reached. Dur ing that period the carrier would be re ceiving the old rates, and if the com mission finally decided that the ad vance was reasonable, no reparation could be awarded. "The country is now demanding repose in its industrial upbuilding. It is not time to experiment and to change the basis upon which the former acts to regulate commerce have been predicated. The re cent law so greatly enlarging the author ity of the commission should have a fair trial before any changes are made. After a trial has been given and normal con ditions have been restored, any defects found In the law can be remedied." Chicago Begins Celebrating. CHICAGO. Feb. 8. In Chicago and throughout Illinois today the celebration of Lincoln week began formally and will reach a climax next Friday, the 100th anniversary of the birth of the great emancipator. Several memorial meet ings were held today in various parts of the. city, and a private collection of 1000 pictures illustrating the life of Lincoln was placed on exhibition. Shoes at factory cost.
